The Police rejected any complaint by the victims including the complaint for the anthrax bomb attack.

They refused to accept the complaints of the female monks of sexual molestation by Ajith and his henchmen.

Instead they criminally pressurised the female monks to file a false rape complaint against Paramahamsa Nithyananda.

They reminded them that the state Police DIG (Deputy Inspector General, Crime Investigation Department) D.V. Guruprasad had himself offered monetary compensation for those filing the rape false charges. The monks were helpless .

Ma Nithya Bhaktikananda Swami a senior Sanyasi recalls the moments of illegal arrest:

“I was on stage for the second press meet that happened on 8th of June 2012 at the Bengaluru Aadheenam. Inside the meditation hall, the Karnataka Navanirman Sene elements were sitting and we did not know. They had hidden their yellow scarves and entered the hall. They just like that started a row out of nothing. They were so rough and tough and we were so unassuming and righteous.


It was such a gross mismatch. I have seen such scenes only in movies. They were simply beating us for more than an hour before leaving the campus. We couldn’t come to terms with what was happening to us. What right had they to enter and break our hard-earned things? What right they had over our life? And what had we done to them? Nothing! How can one television channel reporter Ajith have so much hate against us? It was of monstrous proportions.

At around 3 pm, I was sitting in the front part of the meditation hall and working on my laptop while the campus was being restored. The police was still in the campus. Residents and volunteers started restoring the meditation hall, putting things back in its place and removing the damaged items. Suddenly a police officer walked towards me. He called me to go with him. I closed my laptop and naively followed him, thinking he was taking me to identify the miscreants of the attacks.

He took me to a waiting van. A lady officer clicked my photograph and gestured to get into the van. There, I saw a few of the residents already sitting. I asked them what was going on. They did not know.

Soon, a few more residents joined us. And the van started. The van went for internal rounds inside the Aadheenam picking more residents, who simply left what they were doing and boarded the van like me. The van left the campus. We had no clue what was happening, where they were taking us, what was their agenda….etc. On the way, we suddenly started getting the feeling that we were being arrested. It became an unspoken undercurrent feeling amidst most of us. We were almost sure of it by the time we reached the police station.

We got off at the police station and were held in custody! 16 of us! We were the victims but they were arresting us! Who complained? It was Ajith of Suvarna Television. So he attacked us the previous day and filed a complaint against us immediately! It was all pre-planned! We could not believe to what extent a persecution could be stretched. Ajith came to the police station and interacted briefly with the policemen. They seemed to know each other well. We later came to know that Ajith had actually identified 16 of us who were seen prominently protecting Swamiji and given instructions to arrest us against his fake complaint which had Swamiji also in it even though Swamiji was not even present on the scene!

Following the CM’s instruction (of 9th June 2012), on 11th June 2012, the State Police entered the Aadheenam led by the Superintendent of Police Anupam Agarwal with at least 100 IPS officers and officers from several Government departmentssuch as Revenue, District Administration etc.

And a raid triggered not by the course of any law but “planned” by malicious persecutors! It was the most frustrating, arbitrary and inhuman treatment that should not be given to any citizen, leave alone a Hindu incarnation!”

“All the containers were opened, all the rooms were searched. They finally went to the sacred Banyan tree area behind the temple. The Banyan tree is a mystical tree and energy hub of the entire Aadheenam. It is not meant to be violated in any form. I was shocked when they started digging under the tree in a location. They were digging as if trillions of Rupees would come out of the ground! I was shocked beyond words. They dug and ofcourse did not find anything.

They completed the search and seize operations and took away material that was never returned to us. It was sheer “justified” daylight robbery.

After seizure, they went around and sealed many metal containers and main parts of the Aadheenam like the welcome center, the administrative office and the accounts office. In those containers we had stored our basic departmental items such as temple items, published books, housekeeping related items, temple ritual items (vibhuti, kumkum, chandan

...) etc. The seal jeopardised our fundamental temple operations. We could not digest that we were 1) attacked 2) nearly killed 3) arrested 4) raided and now our main operational buildings sealed!

The entire illegal raid and seizure was presented in the mainstream-media as if a host of great criminal activities had been going on and the officers were there to discover all of that. However, none of the 100 officers who raided, bothered to give a statement to the media to clarify that they raided but could not find any trace of any kind of illegal activity in the sacred temple monastery.”




Ma Nithya Advaitananda (Principal of Gurukul) recalls, “The police came as scavengers, plundering and sealing our Gurukul…..It was a rude shock for the children… they were traumatized beyond repair, even today when they see anyone with a police uniform, they shiver and weep! Nothing was safe! We were not even through the ordeal of attack by the Suvarna TV mob, and here the police, who were supposed to protect the children were searching the Gurukul and disgustingly throwing away the school supplies! I ran every minute to safeguard the security of the children, as they shed hot tears seeing their place of study sealed.

What is the law in illegally sealing the Gurukul where we are creating the divine children, who will lead and serve humanity with truth and love?

Curfew (Indian Penal Code - IPC 144) imposed

| What is Unlawful assembly and Curfew Section 144 of the Criminal Procedure Code (CrPC) of 1973 empowers an executive magistrate to prohibit an assembly of more than four persons in an area . According to Sections 141-149 of the Indian Penal Code (IPC), the maximum punishment for engaging in rioting is rigorous imprisonment for 3 years and/or fine. Every member of an unlawful assembly can be held responsible for a crime committed by the group. Obstructing an officer trying to disperse an unlawful assembly may attract further punishment. These sections cannot be imposed on private property and is only applicable to public places. |

Illegal Curfew (IPC 144) Imposed - Right to life denied

The most draconian imposition of force was the slapping of the Section IPC 144 on the entire Bengaluru Aadheenam and its residents. It meant: not more than four residentscould even stand and talk to each other anywhere! This imposition included not assembling for daily puja (ritualistic worship) inside their own temple on their own private property. The fundamental human rights of the residents to practice their religion and live freely was denied.

| The residents were stunned by the 144 ruling… Ma Nithya Bhaktikananda Swami recalls , “It took at least 48 hours for all the residents to understand the strange ruling in place. It literally meant, a family of five could not sit together and talk in their own house! Firstly, for the residents, it was not an instruction from "Swamiji", so they did not take it seriously. We had to explain to them that it was a rule imposed by the State of Karnataka and it had to be followed. They were stunned. A dozen questions were asked about the ruling and its basis. When we explained to them that the whole thing was being illegally done, they were felt so suffocated and pained. For a community that "lived" in |

| congregation, the ruling was like snatching away the source of life itself. They kept asking us what harm their innocent congregation would do to anyone. There was only one answer to ALL their questions: ‘Everything is being done illegally to us’. No other answer." |

“On June 11, 2012, I was staying in Bengaluru Aadheenam when the Aadheenam was illegally sealed. The police illegally entered and started searching the place. They began attacking us. None of us knew what was happening but we all gathered in Ananda sabha as soon as the news spread that they we were being attacked. I never imagined that a situation would come like this where we were all locked down in one place for so many hours in the day without food, water or any chance to use the restroom.

I remember hearing that it was none other than the police that were attacking us. They were supposed to be the ones protecting us but here they were violating our most basic right to live and be free. They were middle aged men. They held maces and axes in their hands. They began filming us.

We were trying to shift around so they wouldn’t find us but somehow, I got separated from the rest of the group. At this time, they cornered me. They dragged me by the hair and stripped me down. I held on to my clothes so hard I felt they would rip off my fingers from their sockets but finally they had me where they wanted: completely exposed.

They each took turns shoving their penis inside me until, one by one by one, they were satisfied. I screamed so loud I could only hear myself and nothing else. I wondered if after this they would kill me. I prayed for it. In fear and complete panic, my stomach released itself. I urinated myself. I was laying naked in my own feces for hours. The few of us who could walk began attending to those who were passed out. We were all mortified, unsure what to say and overwhelmed by the gruesome and collection of all of our pain.”

Brutal Genocide - Attempts on Life of Monks

“In April 2012, there was was an illegal curfew imposed upon us, where we were not allowed to group together beyond four people, or move about the campus. This made survival extremely difficult, as even

moving food and resources was becoming impossible. We had women and children all huddled in one spot, hiding from the mobs that infiltrated the campus.

We sneaked into one of the halls, where we had stored the food. Before we could even see them, they grabbed us by the hair and began dragging us through the hall. They tied all of my limbs together, with four men who grabbed my hands and feet. They grabbed me by my mala, choking me, till it broke off my neck.

They stripped off all our malas and sacred saffron clothes, and flushed it down the toilets laughing like maniacs.. It makes me furious to even remember that they threw my Guru, my Swamiji’s photos into the same toilet bowls. They then started to set photos on fire and threw them into the mix. They were laughing hysterically, and at this point I could smell the alcohol on his breath. They were drunk and violent. It was like a war zone, wherever I saw I could see our female Sanyasis being raped and abused, screaming in pain, and trying to save their dignity. I was feeling very helpless, not knowing what to do, except so angry!!.

They were barbarous and tortured me physically, by tying me up and ripping each nail out of my fingers and toes using a pliers. The pain was excruciating and i almost nearly fainted screaming with intolerable pain. But they continued not paying heed to my blood-curdling screams. As I tried to get away, they grabbed me by my both hands and dragged me through the gravel, skinning my back and limbs. My flesh was raw from all the beatings.

I was barely alive, half unconscious, yet they continued to punch and kicking, laughing villainously. With each punch to the gut, I became more and more uneasy. They were spitting on me and shouted vulgar slang at me kicking at my genitals. I never experienced this kind of agony or brutality in my life.

I felt like i was in the enemy camp in a warzone. I could not believe or understand why they would torture against innocent monks who were living peacefully and only spreading peace and meditation for humanity.”

Gross Religious Abuse and Violation

“In 2012, when the Aadheenam was sealed, a similar incident happened where the police invaded the property and when on a spree of mass destruction. Again, I was at the temple busy with rituals and had not caught word of what was happening on the other side of campus. When I saw several policemen entering the temple with their shoes on, my heart completely stopped. I had a flashback to the first time we had a CID raid and I began to panic.

They came directly towards me and thrashed me in the hip with their baton. They held me by gunpoint and this time made me defile the deities. I flat out refused but they continued to threaten me. One of the policemen took his pistol and wacked me over the head with it. The sheer force of the strike knocked me out.

When I woke up, I was tied up in a corner with blood profusely streaming down my neck. I looked around to see that they had completely degraded the sanctity of the temple. All the deity jewels and clothes were removed and piled in one corner, covered in drainage. They ripped off large branches of our sacred banyan tree and threw them around the temple. I saw them entering the garba mandir with their shoes on and throwing dirt on our sacred Nithyanandeshwara Sadashiva Lingam. I screamed for them to stop but they ignored me and continued on their rampage. Dizzy from all the blood loss, I passed out again. When

I woke up, I found myself in the dispensary under the care of the Aadheenam nurse. I could not bare to think what happened to our deities.”

Arbitrary and Illegal - No written order was given to neither authorizing the raid nor for the sealing of the aadheenam.

The imposition of Section 143, 144 of the Indian Penal Code (IPC). This was a completely illegal operation that not only violated the human rights, but instilled terror and irreparable trauma to residents and especially the children.

CRIMES OF THE STATE POLICE

Section 144 of the IPC cannot be applied to a private property. The State Police illegally applied it to the Aadheenam, which is a private property.

The Chief Minister abused his power as the head of the State to drive out and displace ‘the victim’ residents by illegally enforcing IPC 144 (Curfew) and Sealing the ashram (which was so grossly illegal, that they did not even mention the section which they wanted to impose).

13 June 2012: State executes a “foxy” second arrest - Attack 6

A planned delay for arrest

For the FAKE complaint filed by Suvarna TV Channel chief Ajith (on 8th June 2012), the Counsel of His Divine Holiness filed for bail, which is His undeniable right. The bail petition came for court hearing. For a fabricated offence and that too bailable, surprisingly, it was “adjourned” to the next day, deliberately leaving it open for the “pre-planned” arrest of His Divine Holiness.

The State police wielded an age-old persecution weapon called “protective custody” where, beyond judicial control or judicial review, the accused is held illegally and tortured; not in a normal prison but in a remote location chosen by the police. It is an “off-the-grid operation” to intentionally isolate and kill the accused.

This was the technique used by the Nazis to mass-kill the jews in the Holocaust of World war II. They were kept under “protective-custody” not in normal prisons but in concentration camps where they were made to languish to death. In the case of his Divine Holiness, the police kept His Divine Holiness not in a normal cell but at an unknown location with no food or water and continuous life threat. The worst nightmares came alive for the disciples, trying to fathom where and what was happening to their Beloved Guru.

Religious rights ridiculed

His Divine Holiness, as per His religious duties as the 293rd pontiff of the Madurai Aadheenam (most ancient traditional monastery), could eat only after offering His daily worship to the traditional Shiva linga deity - an unbroken tradition for 2000 years. He could not even drink water until then.

The Police in their heady power, ridiculed and denied His Divine Holiness from his religious worship, and refused to give him His deity. United Nations Declaration of Human Rights - Article 18 empowers humans to freedom of religion, however the police had no humanity.

It is a Shaivagamic tradition that one doesn’t eat until he offers his daily puja (ritualist worship) to Shiva-linga (deity). The State police stop His Divine Holiness from worship and the mainstream media publish this story to ridicule Him.

14 June 2012: Bail granted

The State Police brought Him back the next day from the unspecified location to the Court. The bail was granted on the basis that there was no evidence for any crime in the complaint against Him. His Divine Holiness was free to go back home. However, the State Police executed the most deceptive part of the attack next.

Police take Him “Off-the-grid”

As soon as His Divine Holiness comes out of the court hearing for the bail petition (which was granted to Him), 600 policemen surround Him.

“On June 14th, 2012, Swamiji was illegally taken into custody. As He left the Aadheenam, many of us followed on foot and in cars. Along with two other male sanyasis, I jumped into a car and chased the vehicle that Swamiji was in. There was a swarm of police cars and policemen all around. As we exited onto the main road, they cut us off and forced us off the road into the dirt. In the process, one of the wheels got punctured.

When we got out of the car to assess the situation, the pulled over behind us and began verbally abusing us. We argued back but then they became physically violent. They dragged us through the dirt skinning our backs and legs and began beating us with their batons in broad daylight. I could not believe that we were being attacked by the police in public like this. Initially, I only tried to protect myself as I didn’t want to cause more trouble by fighting back, but I quickly realized that they were not going to relent. I attempted to fight back but that only made them more aggressive and angry. They threw me to the ground and kicked me in the groin. As I writhed in pain, they chuckled to themselves. Soon, the scene began to draw a crowd and they had to quickly gather themselves to leave but not before threatening us. They tried to intimidate us with more false cases against ourselves and Swamiji.”

“The day that Swamiji was arrested in June of 2012, many aadheenavasis followed Him to the station. I stayed back with a few other men to secure the Aadheenam. As all of the policemen left, we closed the gate and waited out the evening and night, rounding the aadheenam. We had no idea what was going on outside the Aadheenam as we had not heard word from anyone yet.

After a few hours, a group of policemen returned, saying they had a few questions for us.

We thought it was strange but wanted to cooperate and let them in. They began acting very suspicious, circling the aadheenam and the bushes as if they were looking for something. We became wary and asked them to leave. Things became very heated and they began yelling at us, saying they can do whatever they wanted.

Suddenly, they became enraged and extremely violent. They took their batons and started beating us to a pulp. I tried to defend myself but that only encouraged them more. Their bodies were taken over by demons with pure hatred in their eyes. They beat me in the face so hard that my jaw dislocated. Repeatedly, they kicked me in my lower abdomen, severely damaging my bowels and causing them bleed. When I was admitted to the hospital, they had to do emergency surgery on me and put a temporary colostomy bag to give my bowels time to heal. Even after it was removed, for many days months, I was not able to have a regular bowel movement without being in excruciating pain.

Later, I learned that the police were trying to plant evidence against us and that is why they were acting so suspicious. Of course, we never got any justice and I still face problems because of those injuries. To this day, I have issues with proper digestion because of the injuries that I faced when the police assaulted us.”

| November 26, 2008, Mumbai terror attacks in the Taj Five Star Hotel . During the 2008 Mumbai 26/11 terror attacks, 10 members of Lashkar-e-Taiba, a terrorist organisation, carried out a series of 12 coordinated shooting and bombing attacks lasting four days across Mumbai, the financial capital of India. 164 people had died and 308 were wounded. During this attack the State failed to respond with speed, coordination, or proper investigation reports. It took 12 hours for the National Security Guard, whose members are trained in rescuing hostages, to get to The Taj as they didn’t receive the official go-ahead to mobilize. However in the case of dehumanization of His Divine Holiness, “speedy mechanism” was implemented by the Chief Minister and 600 battalion police and additional paramilitary forces were waiting for Him outside the court, to showcase Him as a terrorist and enemy of the State, dragging Him throughout the Bengaluru city - Silicon Valley of India - spending Rs. 3 crore ($½ Million USD) of public taxpayers’ money. |

Detaining Him in an unknown location instead of a prison.

Denying His religious right to offer a 2000-year-old unbroken tradition of worship.

14 June 2012: A deceptive police-attack, a “hijack” to kill - Attack 7****The police hijack Him in another direction

Once the bail was given, His Divine Holiness was free as per law. A huge mob had gathered outside. The police told the disciples that they would escort Him out and take Him in their vehicle to the Aadheenam.

The guileless disciples already fearing a mob-lynch on His Divine Holiness thought it best to go with the Police plan. The moment His Divine Holiness entered the vehicle, the door closed and t o the shock and horror of the disciples, the vehicle moved in the opposite direction on hitting____the road. Once again, things went “off-the-grid” for the disciples. With racing hearts, they followed the police van as fast they could.

Inside the vehicle, the Police displayed their deceitful fangs. The DSP (Deputy Superintendent of Police) SP Ramalingappa, took out a legal document written in local Kannada script (not readable by His Divine Holiness) and asked Him to sign on it saying that due to high security risk, they were going to take Him up to Hosur (Karnataka-Tamilnadu border) with protection, instead of the Aadheenam, and that the document needed to be signed to take His consent for the same.

At first His Divine Holiness refused to sign, and asked to speak to His lawyer. __The Police denied____Him any call to lawyer.__Meanwhile, the Bidadi Police Station Sub Inspector Vijayakumar intervened and gave Him “false” confidence that he has read it and it is the same as what was told, and that His Divine Holiness could sign on it. His Divine Holiness reluctantly signed the document. He had no clue however, that the vehicle was already moving in the wrong direction.

The vehicle suddenly took a sharp entry into the District Magistrate’s (DM) Office at Ramanagara (the district where the monastery) and the gates were instantly closed and all entries blocked. The disciples froze in their track unable to reach their Guru.

At the District Magistrate’s Office

Sri Nithya Atmaprabhananda, the administrator was given entry after persistent pleadings to the gate guards about his required presence with His Divine Holiness. As he rushed in the District Magistrate’s court, he saw the entire place packed with police officers.

The District Magistrate was seated high up as the judge. His Divine Holiness was made to stand____alone in the accused stand for long, and the room was swarmed by CID in civilian clothes, Police Officers, and the Press. He did not know what was happening, when he had been granted bail already.

Not waiting for His defense Counsel, the proceedings started. The DM informed Him that the State police had filed a complaint on Him to the DM under Section 107 and Section 151 of Cr.PC. The complaint was in view of the multiple “Law and Order” related incidents that took place at His Aadheenam the past few days. The planned one-sided attacks against Him were termed “Law and Order situations” and a threat for the entire Bidadi village (where the Aadheenam was located)! In reality, there was life-threat only for the disciples of His Divine Holiness living there. The **“Big Lie” of a “Law and Order situation”**was told again.

Sri Nithya Atmaprabhananda recounts the abnormally “high-alert high-security” zone that was created in the DM’s office that day, with the place swarming with CID officers in civilian clothes and press persons, while all entries were blocked for anyone else. Press persons were seen for a kilometer stretch outside the DM office. The CID officers were tracking and probing each and every move of anyone from the Aadheenam.

The Counsel to His Divine Holiness was yet to arrive. He was left alone to defend Himself. Sri Nithya Atmaprabhananda paraphrases the words of His Divine Holiness when He started pleading humbly in front of the District Magistrate: I am not disturbing public peace. But if

you feel that me being in here is going disturb the public peace, I will stay away from Bidadi. I will not have any Press Meet.


But the State Police intentions were otherwise. **They wanted to keep Him and exterminate Him.**The public prosecutor maliciously argued that He moving out will not solve the issue, and that he will continue to cause “trouble to public”.

Sri Nithya Atmaprabhananda paraphrases His Divine Holiness’ words thus: I was given a paper on which they asked me to sign, saying it was for my protection. I did not know a fresh case has been filed against me. Let me meet my lawyer.” But denying Him any right of defense, through an “abnormally rushed” proceedings, the DM directly passed the order before the lawyer arrived. The most unlawful order was passed, remanding Him to 7 days of retention in the Mysore Central Prison.

The Counsel arrived shortly. He requested for a copy of the FIR filed against His Divine Holiness and asked for time to prepare his arguments. Brushing aside his request amidst the “pre-meditated” operations, His Divine Holiness was taken away to the Mysore prison. And after that, the FIR copy was handed over to the lawyer!
