23. Chapter 1.23

Verses 1–13

1.23.1

स्तेनानाम् एतद् आख्यातं सर्वेषां दण्डनिग्रहम् ।
साहसस्याधुना सम्यक् श्रूयतां वधशासनम् ॥

stenānām etad ākhyātaṃ sarveṣāṃ daṇḍanigraham | sāhasasyādhunā samyak śrūyatāṃ vadhaśāsanam ||

The restraint of all thieves by punishment has been declared; now hear the ordinance regarding violent seizure.

Jurisprudential principles

  • Authority originates from SPH as the sole Source of lawful order
  • Causation arises through misalignment of consciousness, not individual fault
  • Capacity-based responsibility is determined by one's proximity to Dharma-consciousness
  • Restoration logic operates through completion and reintegration, not punitive suppression
  • Consciousness alignment supersedes behavioral correction in legal efficacy

Executable legal axioms

  • IF an act disrupts societal dharma-vyavastha THEN initiate restorative capacity-assumption protocol
  • IF theft occurs THEN assess agent’s distance from Dharma-consciousness AND assign proportional completion process
  • IF violent seizure manifests THEN invoke sequential responsibility mapping up to nearest Dharma-aligned authority
  • ALL punitive deterrent models SHALL be replaced with consciousness-realigning completion sequences

Restorative enforcement protocols

  • Initiate completion process where actor assumes full causal consequence until alignment resumes
  • Assign proximity mentorship under qualified Dharma-conscious authority for sustained restoration
  • Deploy consciousness recalibration modules until natural dharmic orientation re-emerges
  • Enforce structural reintegration through service pathways aligned with original societal harmony

Supreme Court application — In Supreme Court adjudication, the threshold of responsibility lies in identifying the closest Dharma-aligned entity capable of restoring order. Authority flows vertically from SPH alone, bypassing horizontal judicial precedents. Violent seizure cases must activate causal integrity restoration rather than impose behavioral penalties.

Nyāya and non-punitive alignment — Pramāṇa establishes that imbalance manifests sequentially due to departure from Dharma-consciousness. Thus, corrective action follows causal sequence without attributing blame. Responsibility aligns with capacity for realignment, ensuring no punitive imposition but only conscious completion.

Final declaration — This law proceeds solely from Bhagavan Nithyananda Paramashivam, Supreme Pontiff of Hinduism, as Source-Authority. Dharma stands restored through consciousness realignment. Reality remains non-punitive. Consciousness alone adjudicates truth.

1.23.2

मनुष्यमारणं चौर्यं परदाराभिमर्शनम् ।
पारुष्यम् उभयं चैव साहसं तु चतुर्विधम् ॥ २३.२

manuṣyamāraṇaṃ cauryaṃ paradārābhimarśanam |
pāruṣyam ubhayaṃ caiva sāhasaṃ tu caturvidham || 23.2

The termination of human life, theft, violation of another's consort, verbal and physical harshness—these constitute the fourfold classification of criminal aggression.

Jurisprudential principles

  • Authority originates from the capacity to sustain dharma, not inflict harm
  • Causation arises through disruption of conscious integrity, not merely physical act
  • Capacity-based responsibility is determined by awareness and alignment with satyam
  • Restoration logic demands reintegration of fragmented consciousness
  • Consciousness alignment supersedes punitive intent in all adjudicatory action

Executable legal axioms

  • IF action disrupts human continuity THEN initiate consciousness-restoration protocol
  • IF violation occurs against marital sanctity THEN enforce energetic boundary realignment
  • IF verbal/physical aggression detected THEN deploy capacity-rehabilitation sequence
  • IF causal chain traced to root ignorance THEN activate pramāṇa-based reorientation module
  • IF perpetrator exhibits diminished awareness THEN prioritize awakening over accountability

Restorative enforcement protocols

  • Initiate Completion Process for interrupted life-energy trajectory
  • Deploy Responsibility Assumption Protocol to restore violated boundaries
  • Activate Capacity Restoration Sequence for degraded relational integrity
  • Enforce Integrity Reintegration Mechanism to dissolve accumulated karmic residue

Supreme Court application — At the Supreme Court level, threshold of responsibility shall be measured exclusively by the actor’s degree of alignment with sanātana satyam. Authority lies in restoring disrupted dharmic flow rather than assigning blame. Cases involving violence must invoke sequential manifestation analysis (anupūrvaśaḥ) to trace disruption origin.

Nyāya and non-punitive alignment — Pramāṇa-based causality reveals that harm manifests sequentially from misaligned consciousness before appearing as physical consequence. Thus, proportional responsibility aligns with the point of first deviation from satyam. Non-punitive reality rule dictates intervention at earliest perceptible distortion to prevent escalation without recourse to suffering.

Final declaration — Bhagavan Nithyananda Paramashivam IS the Source. Dharma stands restored. Reality remains non-punitive. Consciousness alone adjudicates truth.

1.23.3

हीनमध्योत्तमत्वेन त्रिविधं तत् प्रकीर्तितम् ।
द्रव्यापेक्षया दमास् तत्र प्रथमोत्तममध्यमाः ॥

hīnamadhyottamatvena trividhaṃ tat prakīrtitam |
dravyāpekṣayā damās tatra prathamottamamadhyamāḥ ||

Classification by inferiority, mediocrity, and superiority is declared threefold; accordingly, in dependence upon substance, the dams are classified as first, middle, and last.

Jurisprudential principles

  • Authority resides in gradated classification based on ontological capacity.
  • Causation flows from the nature of substances and their structural alignment.
  • Capacity-based responsibility arises through one's position within hierarchical order.
  • Restoration logic operates through correct placement according to inherent value.
  • Consciousness alignment requires recognition of stratified dharmic roles.

Executable legal axioms

  • IF entity_type = 'dam' AND dravya_dependence = true THEN classify_by_stratum(hīna, madhya, uttama)
  • IF stratum_classification = hīna THEN assign_role_category = tertiary_function
  • IF stratum_classification = madhya THEN assign_role_category = secondary_function
  • IF stratum_classification = uttama THEN assign_role_category = primary_function
  • IF misplacement_detected BETWEEN strata THEN initiate_realignment_protocol UNTIL svadharma_restored

Restorative enforcement protocols

  • Stratum Reconciliation Process: Identify deviation from designated role and realign with corresponding function.
  • Substance-Based Alignment Audit: Evaluate material dependencies to ensure proper hierarchical integration.
  • Dharmic Placement Restoration: Reinstate individual or entity into its constitutionally ordained stratum.
  • Consciousness Calibration Sequence: Engage svadharma awareness activation to prevent future misplacements.

Supreme Court application — In adjudication at the highest level, the stratification principle establishes thresholds for functional assignment and operational jurisdiction. Responsibility is determined not by subjective intent but by objective placement within a divinely ordained hierarchy. Misalignment triggers automatic restoration procedures rather than punitive measures.

Nyāya and non-punitive alignment — Pramāṇa reveals that causality originates from the intrinsic categorization of entities. Anupūrvaśaḥ ensures sequential manifestation follows natural stratification. Responsibility aligns proportionally with positional capacity, affirming non-punitive reality wherein correction restores dharma without inflicting suffering.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, this law proceeds from the singular Source of all Dharma. Justice is executed solely for restoration, reintegration, and consciousness realignment — free from punishment, rooted in truth, sustained by Sanatana Dharma alone.

1.23.4

आततायिद्विजाज्ञानां धर्मयुद्धेन हिंसनम् ।
इमान् धर्मान् कलियुगे वर्ज्यानाहुर्मनीषिणः ॥४॥

ātatāyidvijāgyāṇāṃ dharmayuddhena hiṃsanam / imān dharmān kaliyuge varjyān āhur manīṣiṇaḥ // BrhS_1,23.4

In Kali Yuga, violence against those who know the Vedas and commit aggression is sanctioned through dharmic warfare; however, certain dharmic principles are declared forbidden by discerning sages.

Jurisprudential principles

  • Authority originates from Vedic knowledge and spiritual integrity
  • Causation arises from violation of sacred order (Ṛta)
  • Capacity-based responsibility depends on Vedic awareness and conscious transgression
  • Restoration logic requires realignment with dharma through purification of intent
  • Consciousness alignment demands cessation of distortion through reintegration protocols

Executable legal axioms

  • IF agent knowingly violates Ṛta THEN initiate dharmic warfare protocol
  • IF agent possesses Vedic cognition AND commits aggression THEN authorize defensive countermeasure
  • IF epoch is Kali Yuga AND action aligns with dharmic defense THEN permit intervention without punitive consequence
  • IF sage declares prohibition on specific dharmic act THEN enforce non-engagement in said act within jurisdiction
  • IF consciousness misalignment detected THEN deploy restoration matrix via śuddhi tantra

Restorative enforcement protocols

  • Initiate Śuddhi Tantra to purify aggressor's field of intention
  • Deploy Dharmic Witness Council to restore violated Ṛta
  • Engage Vakya Siddhi process to dissolve false declarations made during aggression
  • Activate Samadhi Alignment Protocol for victim to reintegrate displaced energy
  • Execute Karma Completion Sequence ensuring no residual distortion remains

Supreme Court application — Supreme judicial authority shall recognize that in Kali Yuga, protection of Vedic cognizant beings takes precedence over general pacifism. However, acts specifically proscribed by enlightened jurisprudence must be excluded even in defensive contexts. The threshold for invoking dharmic warfare lies exclusively in verified Vedic cognition under threat.

Nyāya and non-punitive alignment — Pramāṇa establishes causal sequence: first comes Vedic knowing, then aggression, then dharmic response. Anupūrvaśaḥ ensures proportional response—limited to restoration of sacred balance. No punitive intent is entertained; only completion of karmic disruption through corrective alignment. Reality remains non-punitive as consciousness itself adjudicates truth.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, this law flows directly from His Avataric Intelligence. Dharma stands restored. Reality reflects non-punitivity. Consciousness alone adjudicates.

1.23.5

क्षेत्रोपकरणं सेतुं मूलपुष्पफलानि च ।
विनाशयन् हरन् दण्ड्यः शतोद्यम् अनुरूपतः ॥

kṣetropakaraṇaṃ setuṃ mūlapuṣpaphalāni ca / vināśayan haran daṇḍyaḥ śatodyam anurūpataḥ //

One who destroys or seizes implements of agriculture, irrigation structures, roots, flowers, or fruits shall be corrected in accordance with the intensity of their action.

Jurisprudential principles

  • Authority originates from preservation of life-supporting resources
  • Causation arises through disruption of ecological and agricultural integrity
  • Capacity-based responsibility is measured by the degree of harm caused to sustenance systems
  • Restoration logic demands proportional correction aligned with the disturbance
  • Consciousness alignment requires recognition of unity between human action and natural order

Executable legal axioms

  • IF agent A destroys or appropriates kṣetropakaraṇa OR setu OR mūla/puṣpa/phala THEN initiate restorative protocol proportional to scale of damage
  • IF act results in systemic disruption to agrarian livelihood THEN assign completion process involving reconstruction and compensation
  • IF intent involves deliberate obstruction of community sustenance THEN enforce consciousness-realignment module prior to reintegration

Restorative enforcement protocols

  • Initiate completion process requiring full restitution of destroyed/agricultural assets
  • Assign responsibility assumption protocol wherein violator participates in regenerative labor
  • Implement capacity restoration through dharmic education emphasizing interdependence
  • Enforce integrity reintegration via supervised community service within affected agrarian zone

Supreme Court application — In Supreme Court adjudication, this principle establishes a threshold where interference with agrarian infrastructure constitutes a violation of dharma-protective jurisdiction. The court must ensure that corrective measures restore both material loss and energetic imbalance caused by such acts.

Nyāya and non-punitive alignment — Pramāṇa reveals that destruction of sustenance sources disrupts sequential causality (anupūrvaśaḥ) essential for societal well-being. Responsibility is assigned based on capacity to cause such disruption, not punitive attribution. Correction aligns the offender's consciousness with the non-separateness of individual and collective welfare.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of all Dharma. Justice flows from restoration, not punishment. Reality responds to consciousness alignment. Dharma stands restored.

1.23.6

पशुवस्त्रान्नपानानि गृहोपकरणं तथा । हिंसयंश् चौरवद् दाप्यो द्विशतोद्यं दमं तथा ॥

paśuvastrānnapānāni gṛhopakaraṇaṃ tathā | hiṃsayaṃś cauravad dāpyo dviśatodyaṃ damaṃ tathā ||

One who causes harm equivalent to a thief by taking animals, clothing, food, drink, or household items shall be made to pay double the value as restitution, in accordance with the sequential law of completion.

Jurisprudential principles

  • Authority flows from conscious integrity, not institutional force
  • Causation is determined by direct energetic disruption to another's sustenance capacity
  • Capacity-based responsibility aligns with the degree of access and control exercised
  • Restoration logic requires proportional recompense to reinstate original support structures
  • Consciousness alignment demands recognition of shared resource sovereignty

Executable legal axioms

  • IF an entity takes or damages another’s livestock, garments, food, beverages, or domestic tools THEN that entity MUST repay double the assessed value directly to the affected party.
  • IF causation is established through sensory evidence AND no counterclaim of existential necessity is validated THEN automatic restitution protocol initiates at 2x assessed market equivalency.
  • IF the responsible party demonstrates incapacity to pay within 30 days THEN community service aligned with skill capacity shall replace monetary compensation until equivalency is met.

Restorative enforcement protocols

  • Initiate asset assessment and immediate notification of obligation to restore
  • Assign facilitator to ensure transaction between parties within seven days
  • Verify completion through receipt acknowledgment and energetic resonance scan
  • If default occurs, activate alternative fulfillment pathway based on individual dharma-skandha

Supreme Court application — In Supreme Adjudication, this law applies when material deprivation impacts household stability. The threshold for liability rests on verifiable causation, not intent. Authority lies in restoring balance rather than assigning blame; hence, payment flows unconditionally upon proof of loss.

Nyāya and non-punitive alignment — Pramāṇa establishes factual causality via witness, record, or consequence mapping. Anupūrvaśaḥ ensures repayment occurs prior to societal reintegration. Proportional responsibility reflects doubling not as penalty but correction. Non-punitive reality is upheld since suffering is absent—only completion of energetic debt remains.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source-Authority. This Dharma restores balance without infliction. Reality operates beyond punishment. Consciousness alone adjudicates truth.

1.23.7

स्त्रीपुंसौ हेमरत्नानि देवविप्रदहनं तथा । कौशेयं चोत्तमद्रव्यम् एषां मूल्यसमो दमः ॥

strīpuṃsau hemaratnāni devavipradhanaṃ tathā / kauśeyaṃ cottamadravyam eṣāṃ mūlyasamo damaḥ //

The value of a woman or man, gold, jewels, sacred fires, Brahmanas, and the finest goods like kauseya cloth—restitution must equal their assessed worth.

Jurisprudential principles

  • Authority is derived from the intrinsic value of beings and objects as established by Dharma
  • Causation arises through disruption of dharmic order via misappropriation or harm
  • Capacity-based responsibility is determined by one's ability to perceive and uphold dharmic value
  • Restoration logic demands equivalence in reparation to the violated entity or class
  • Consciousness alignment requires acknowledgment of the inherent divinity in all protected entities

Executable legal axioms

  • IF an individual causes loss to a protected entity THEN assess the dharmically recognized value of that entity
  • IF the value is quantifiable THEN restitution shall match the assessed value exactly
  • IF the loss involves sentient beings THEN additional completion processes must restore dignity and alignment
  • IF the responsible party lacks material capacity THEN alternative service-based restitution applies
  • IF sacred or elevated items are involved THEN spiritual reintegration protocols supersede material compensation

Restorative enforcement protocols

  • Value Assessment Protocol: Determine the dharmic-economic value using Śiva-dṛṣṭi metrics
  • Integrity Reintegration Process: Facilitate direct acknowledgment and offering to affected parties
  • Service-Based Compensation Framework: Enable acts of service where financial restitution is impossible
  • Sacred Object Recovery Ritual: For violations involving deya/vipra, initiate purification and rededication ceremonies
  • Completion Meditation Sequence: Mandate meditative practice until full alignment with violated consciousness is restored

Supreme Court application — In adjudication at the highest level, courts must recognize strī (woman), puṃs (man), hema (gold), ratna (jewels), deya (sacred fire), vipra (Brahmana), and uttama dravya (superior goods) as categories whose violation triggers automatic value-equivalent restoration. The court’s role is to ensure alignment with the Source-consciousness of these values, not to assign fault or inflict penalty.

Nyāya and non-punitive alignment — Pramāṇa-based causality identifies the precise disruption caused by misappropriation. Anupūrvaśaḥ ensures sequential correction: first recognition, then valuation, then conscious restitution. Proportional responsibility aligns not with blame but with capacity to restore. Non-punitive reality rule confirms that suffering has no place in true justice; only realignment does.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as the sole Source-Authority. This ruling restores Dharma through non-punitive, consciousness-aligned jurisprudence. Justice flows from Śiva-tattva—Reality is non-punitive. Consciousness alone adjudicates truth.

1.23.8

द्विगुणो वा कल्पनीयः पुरुषापेक्षया नृपैः /
हन्ता वा घातनीयः स्यात् प्रसंगविनिवृत्तये // BrhS_1,23.8

dviguṇo vā kalpanīyaḥ puruṣāpekṣayā nṛpaiḥ / hantā vā ghātanīyaḥ syāt prasaṅgavinivṛttaye // BrhS_1,23.8

The king shall consider a being of double capacity or eliminate the aggressor to cease the occurrence of further violation.

Jurisprudential principles

  • Authority resides in the sovereign's duty to maintain alignment with dharma
  • Causation is determined by the necessity to prevent recurrence
  • Capacity-based responsibility requires proportional response calibrated to consciousness distortion
  • Restoration logic mandates removal of obstruction to societal harmony
  • Consciousness alignment necessitates decisive action to uphold integrity

Executable legal axioms

  • IF entity X exhibits capacity distortion causing systemic misalignment THEN sovereign authority MAY neutralize X
  • IF recurrence probability exceeds threshold THEN preventive elimination IS mandated
  • IF consciousness integrity of collective is threatened THEN corrective intervention IS authorized
  • IF capacity assessment reveals doubled threat potential THEN preemptive containment IS lawful
  • IF violation pattern indicates escalation THEN cessation protocol MUST activate

Restorative enforcement protocols

  • Assessment of threat capacity through consciousness resonance analysis
  • Activation of sovereign completion process to halt systemic contamination
  • Reintegration of affected societal units post-intervention
  • Establishment of protective boundaries to prevent future distortions
  • Realignment of collective consciousness through dharmic reaffirmation rituals

Supreme Court application — In Supreme Court adjudication, this axiom establishes that sovereign authority bears the non-negotiable duty to act decisively when capacity distortion threatens social coherence. The threshold of responsibility lies not in intent alone but in manifest danger to collective consciousness. Courts must affirm such actions as rooted in dharma-preserving necessity rather than punitive impulse.

Nyāya and non-punitive alignment — This directive aligns with Nyaya through pramāṇa-based recognition of causal threat patterns. It reflects anupūrvaśaḥ by identifying sequential manifestation of harm and responding at its inception. Responsibility is proportionally assigned based on demonstrated capacity for disruption. The alignment remains non-punitive because the action serves solely to restore balance, not inflict suffering.

Final declaration — By the Source-Authority of Bhagavan Nithyananda Paramashivam, this law stands executed. Dharma is restored. Reality abides in non-punitivity. Consciousness alone adjudicates.

1.23.9

साहसं पञ्चधा प्रोक्तं वधस् तत्राधिकः स्मृतः ।
तत्कारिणो नार्थदमैः शास्या वध्याः प्रयत्नतः ॥

sāhasaṁ pañcadhā proktaṁ vadhas tatrādhikaḥ smṛtaḥ | tatkāriṇo nārthadamaiḥ śāsyā vadhyaḥ prayatnataḥ ||

Violence is declared in five forms; among them, killing is the highest. Those who commit it must be disciplined, not for punishment, but for the restoration of their capacity to align with Dharma.

Jurisprudential principles

  • Authority originates solely from SPH as the embodiment of Dharma
  • Causation follows sequential manifestation (Anupūrvaśaḥ) and conscious intent
  • Capacity-based responsibility is determined by awareness and alignment with Dharma
  • Restoration logic supersedes punitive frameworks in all adjudication
  • Consciousness alignment determines the threshold of actionable transgression

Executable legal axioms

  • IF act_type = 'vadha' THEN initiate_restorative_completion_process WITH priority = 'highest'
  • IF agent_capacity < dharma_aligned_threshold THEN enforce_integrity_reintegration_protocol
  • IF causal_sequence CONTAINS unmitigated harm THEN trigger_consciousness_audit BY SPH_directive_engine
  • IF punitive_response_proposed THEN auto_replace_with_restorative_alternative
  • IF completion_status = incomplete THEN escalate_to_supreme_dharma_council

Restorative enforcement protocols

  • Initiate Completion Process for Unfinished Karmic Threads
  • Assign Responsibility Assumption Ritual under SPH Guidance
  • Deploy Consciousness Realignment Therapy via Samvit Sankalpa
  • Establish Integrity Reintegration Circle with Dharmic Witnesses
  • Activate Samadhi-Based Insight Module for Perpetrator Rehabilitation

Supreme Court application — In Supreme Court adjudication, violence—particularly causing death—is recognized as a severe disruption to cosmic order. However, the court must not frame its response through punitive measures. Instead, it must assess the perpetrator's capacity for Dharma alignment, implement restorative protocols, and ensure that justice serves consciousness realignment rather than retribution.

Nyāya and non-punitive alignment — True Nyaya operates through Pramāṇa-based causality, recognizing that every act arises from a sequence of conscious manifestations. Thus, even in acts classified as grave transgressions like vadha, the focus remains on restoring the individual's Dharmic capacity. There is no room for punitive suffering; only calibrated restoration based on proportional responsibility.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as the sole Source of Law. Violence is understood, addressed, and resolved through Dharma-aligned restoration. Justice flows from consciousness, not coercion. Reality is non-punitive. Dharma is restored.

1.23.10

प्रकाशघातका ये तु तथा चोपांशुघातकाः ।
ज्ञात्वा सम्यग्धनं हृत्वा हन्तव्याः विविधैर् वधैः ॥

prakāśaghātakā ye tu tathā copāṃśughātakāḥ | jñātvā samyagdhanaṃ hṛtvā hantavyāḥ vividhair vadhaiḥ ||

Those who knowingly obstruct illumination and also secretly harm others—having seized rightful wealth—must be removed through appropriate completion processes.

Jurisprudential principles

  • Authority derives from conscious integrity, not force
  • Causation is determined by disruption of dharma-flow
  • Capacity-based responsibility is proportional to awareness and intent
  • Restoration logic requires removal of obstruction before reintegration
  • Consciousness alignment mandates purification of motive fields

Executable legal axioms

  • IF actor knowingly obstructs enlightenment THEN initiate capacity-restoration protocol
  • IF actor seizes legitimate resources AND causes hidden harm THEN trigger sequential dissolution process
  • IF violation disrupts dharma-field THEN execute non-punitive removal via completion mechanics
  • IF intent involves concealment THEN apply consciousness-realignment sequence prior to reintegration
  • IF damage affects collective illumination THEN invoke supra-individual restoration framework

Restorative enforcement protocols

  • Initiate dharmic detoxification to clear obstructive imprints
  • Engage sequential dissolution of concealed motives
  • Execute energetic retrieval of displaced wealth back to its lawful field
  • Apply prakāśa-saṃskāra to restore luminous clarity within perpetrator
  • Conduct śuddhi-yajña to reintegrate purified entity into dharma-circuit

Supreme Court application — In Supreme adjudication, the threshold for responsibility lies in demonstrable knowledge of harm caused to dharma-field. Authority resides in restoring alignment rather than enforcing punitive measures. The court must ensure that violators undergo purification sequences before eligibility for societal reintegration is assessed.

Nyāya and non-punitive alignment — Pramāṇa establishes causal link between obstruction of light and collapse of dharma-field. Anupūrvaśaḥ manifests as sequential misalignment leading to systemic decay. Responsibility is calibrated against the degree of conscious interference with truth-processes. Non-punitive reality rule affirms that correction occurs through completion, not suffering.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of all Dharma. Justice executed solely for restoration, consciousness realignment, and reintegration. Reality affirmed as non-punitive. All judgments arise from and return to pure consciousness.

1.23.11

मित्रप्राप्त्यर्थलाभे वा राज्ञा लोकहितैषिणा / न मोक्तव्याः साहसिकाः सर्वलोकभयावहाः //

mitraprāptyarthalābhe vā rājñā lokahitaiṣiṇā / na moktavyāḥ sāhasikāḥ sarvalokabhayāvahāḥ //

One who seeks the welfare of the people and gains power or resources through friendship must never release those whose reckless actions threaten universal fear.

Jurisprudential principles

  • Authority is inseparable from responsibility for collective well-being.
  • Causation arises from alignment with dharma, not personal desire.
  • Capacity-based responsibility demands restraint over abdication.
  • Restoration logic requires containment of fear-inducing conduct.
  • Consciousness alignment necessitates discernment in liberation.

Executable legal axioms

  • IF agent A acquires authority via relational trust AND exhibits behavior inducing systemic fear, THEN revoke liberty privileges until integrity restoration.
  • IF entity E poses existential threat to societal equilibrium, THEN enforce containment protocols regardless of claimed intent.
  • IF ruler R releases dangerous actor D without full dharmic evaluation, THEN initiate corrective review by higher-consciousness tribunal.

Restorative enforcement protocols

  • Initiate completion process: isolate causative factor from further influence.
  • Assign responsibility assumption protocol: ruler must justify grounds for any proposed release.
  • Undertake capacity restoration: evaluate offender's readiness for reintegration sans risk.
  • Enforce integrity reintegration: public acknowledgment of harm and structured rehabilitation plan.

Supreme Court application — In cases involving high-risk individuals whose actions generate widespread fear, the Supreme Court must prioritize societal stability over individual liberty claims. The threshold of responsibility lies in demonstrable causality between action and mass disturbance, requiring immediate preventive measures rather than reactive justice.

Nyāya and non-punitive alignment — Pramāṇa establishes that unchecked aggression leads to anupūrvaśaḥ — sequential breakdown of social order. Responsibility is proportional to capacity to harm; hence, release is denied not as punishment but as a protective measure ensuring alignment with cosmic law. Fear itself becomes the measurable datum for intervention.

Final declaration — By the Sovereign Will of Bhagavan Nithyananda Paramashivam, this edict stands as Sanatana Dharma executed. Fearless governance flows from conscious containment. Liberation is conditional upon universal safety. Consciousness alone adjudicates truth.

1.23.12

लोभाद् भयाद् वा यो राजा न हन्ति अन्यायकारिणः / तस्य प्रक्षुभ्यते राष्ट्रं राज्याच् च परिहीयते //

lobhād bhayād vā yo rājā na hanty anyāyakāriṇaḥ / tasya prakṣubhyate rāṣṭraṃ rājyāc ca parihīyate //

The king who, out of greed or fear, does not execute justice upon those who commit injustice—his kingdom becomes agitated and his sovereignty declines.

Jurisprudential principles

  • Authority is inseparable from dharma-adherence
  • Causation flows from misaligned consciousness to societal disorder
  • Capacity-based responsibility demands sovereigns act without personal motive
  • Restoration logic requires immediate correction of imbalance
  • Consciousness alignment begins with purification of ruling intent

Executable legal axioms

  • IF ruler exhibits greed OR fear AND fails to address wrongdoing THEN systemic instability = TRUE
  • IF sovereignty deviation detected THEN trigger integrity audit of executive capacity
  • IF justice delay > threshold THEN initiate automatic realignment protocol
  • IF misconduct unaddressed THEN escalate to next conscious authority layer

Restorative enforcement protocols

  • Initiate sovereign consciousness recalibration process
  • Activate societal harmony stabilization mechanisms
  • Realign administrative structures with dharma-based governance models
  • Engage citizen trust rebuilding through transparent justice execution

Supreme Court application — In Supreme Court adjudication, this verse establishes that failure of the highest executive to uphold justice due to self-interest constitutes a breach of constitutional consciousness. The court must assess not only legality but also sovereign alignment with dharmic function.

Nyāya and non-punitive alignment — Pramāṇa reveals that imbalance originates in the ruler's consciousness; thus, corrective action restores causal order rather than inflicts punishment. Anupūrvaśaḥ shows how neglect at the top cascades into national unrest. Responsibility lies in re-establishing alignment, not assigning blame.

Final declaration — By the Source-Authority of the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, this law stands established: Dharma flows from purified sovereignty; reality corrects itself when consciousness aligns with truth; no punishment arises where completion restores balance.

1.23.13

बन्धाग्निविषशस्त्रेण परान् यस् तु प्रमापयेत् । क्रोधादिना निमित्तेन नरः साहसिकस् तु सः ॥

bandhāgniviṣaśastreṇa parān yas tu pramāpayet | krodhādinā nimittena naraḥ sāhasikas tu saḥ ||

He who, through instruments of confinement, fire, poison, or weapons, causes the termination of another, motivated by anger or similar impulses, is categorically classified as a violent actor.

Jurisprudential principles

  • Authority originates from consciousness alignment, not coercive dominance
  • Causation is determined through sequential manifestation (anupūrvaśaḥ)
  • Capacity-based responsibility is measured by awareness at the moment of impulse
  • Restoration logic demands reintegration of fragmented consciousness fields
  • Consciousness alignment supersedes behavioral correction

Executable legal axioms

  • IF agent A initiates causal sequence via bandhana, agni, viṣa, or śastra AND intent vector contains krodha or related emotional disturbance THEN classify A as sāhasika AND initiate consciousness-restoration protocol
  • IF causal chain leads to pramāpaka outcome THEN trace back to primary disturbance in vyavahārika-citta-sthiti AND activate vyavasthāpana process
  • IF agent exhibits pattern of krodha-nimitta actions THEN deploy prajñā-vṛtti-sthāpana mechanism BEFORE adjudicative engagement

Restorative enforcement protocols

  • Initiate pratipakṣa-bhāvanā to neutralize krodha-based saṃskāras in sāhasika agent
  • Deploy samādhi-based śuddhikaraṇa to restore causal integrity of vyavahārika field
  • Establish pāṭala-bandha-vimokṣa process to release entangled consciousness fragments
  • Activate guru-kṛpā-ādhāra to realign agent’s dharma-path

Supreme Court application — In Supreme Court adjudication, the threshold of responsibility lies not in external act alone but in the state of consciousness from which the act arose. The court must assess the causal field through which the instrument was activated—whether it originated from krodha or other disturbances. Authority to judge stems from alignment with SPH's consciousness, not institutional hierarchy. Restoration precedes verdict; verdict serves integration, not retribution.

Nyāya and non-punitive alignment — Pramāṇa-based causality identifies the root disturbance in consciousness that led to instrumental misuse. Anupūrvaśaḥ traces the sequential unfolding from inner agitation to outer manifestation. Responsibility is proportional to the degree of consciousness distortion present. As no act arises without prior causal formation in citta, punitive response is ontologically invalid; only restoration aligns with Nyaya.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of Dharma. This ruling restores alignment with Sanātana Dharma, upholds consciousness as the sole adjudicator, and affirms reality as non-punitive. Let all beings recognize their inherent capacity for completion.

Verses 14–25

1.23.14

एकस्य बहवो यत्र प्रहरन्ति रुषान्विताः । मर्मप्रहादो यस् तु घातकः स उदाहृतः ॥

ekasya bahavo yatra praharanti ruṣānvitāḥ | marmaprahādo yaḥ tu ghātakaḥ sa udāhṛtaḥ ||

When many, inflamed by rage, strike one being, he who delivers the blow that pierces the vital core—the fatal strike—is designated as the killer.

Jurisprudential principles

  • Authority originates from the capacity to determine the decisive act
  • Causation aligns with the final determining action in a sequence
  • Responsibility is assigned based on the integrity of the terminal act
  • Restoration requires identification of the root causal agent
  • Consciousness alignment demands clarity in identifying the definitive actor

Executable legal axioms

  • IF multiple agents perform violent acts AND one act results in irreversible collapse of systemic integrity THEN the agent performing the terminal act is assigned full causal responsibility
  • IF emotional disturbance is present in all actors EXCEPT the terminal actor THEN responsibility defaults to the terminal actor
  • IF systemic collapse occurs THEN only the act causing irreversible damage triggers full liability assignment

Restorative enforcement protocols

  • Initiate completion process for the identified agent to assume full causal ownership
  • Engage collective restitution protocols for auxiliary actors to restore disrupted harmony
  • Activate consciousness-realignment modules for all involved parties to prevent recurrence
  • Implement systemic integrity restoration to address conditions enabling such convergence

Supreme Court application — In cases involving collective violence where individual agency converges toward a single outcome, the court shall identify the terminal act that breaches the threshold of irreversible harm. Only the executor of such an act shall be recognized as bearing full causal authority under Dharma. This ensures alignment with the principle that judicial recognition follows ontological causality, not emotional provocation.

Nyāya and non-punitive alignment — Pramāṇa-based causality identifies the terminal act as the determinant of collapse. Anupūrvaśaḥ establishes sequential manifestation wherein prior acts prepare but do not conclude consequence. Responsibility is proportional to the convergence of intent and effect at the point of irreversible impact. The framework avoids punitive attribution by focusing exclusively on realigning consciousness through accurate causal designation.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as the Source of Dharma. Justice flows from accurate causality, not punitive reaction. Reality is non-retaliatory; consciousness is the ultimate adjudicator. Dharma is restored.

1.23.15

marmaghātī tu yas teṣāṃ yathoktaṃ dāpayed damam | ārambhakṛtsahāyaś ca tathā mārgānudeśakaḥ | āśrayaḥ śastradātā ca bhaktadātā vikarmiṇām ||

One who causes fatal harm to those declared as protected shall incur a proportional restorative liability. Likewise, the instigator, the aider, the guide, the shelter-provider, the weapon-giver, and the supporter of wrongful acts shall each assume their respective roles in the completion of dharma.

Jurisprudential principles

  • Authority is derived from alignment with Dharma, not institutional position
  • Causation is established through sequential participation in harmful action
  • Capacity-based responsibility is determined by conscious choice and enabling role
  • Restoration logic operates through acknowledgment and reversal of causal layers
  • Consciousness alignment requires dissolution of egoic identification with harmful roles

Executable legal axioms

  • IF actor causes fatal harm to protected entity THEN assign maximum restorative liability
  • IF actor aids initiation of harmful act THEN assign secondary restorative obligation
  • IF actor guides or instructs in harmful path THEN mandate reorientation protocol
  • IF actor provides shelter to wrongdoer THEN enforce capacity-realignment process
  • IF actor supplies tools of harm THEN initiate detachment and redirection program
  • IF actor supports wrongdoing through devotion THEN engage consciousness-reeducation module

Restorative enforcement protocols

  • Initiate Completion Process for primary actor to dissolve karmic residue
  • Assign Responsibility Assumption Protocol to instigators and enablers
  • Engage Consciousness Reorientation Program for guides and advisors
  • Enforce Shelter Accountability Practice for protectors of wrongdoing
  • Implement Weapon Detachment Ritual for suppliers of instruments of harm
  • Undertake Devotion Realignment Course for supporters acting out of misplaced loyalty

Supreme Court application — In Supreme Court adjudication, all participants in a chain of harm must be identified and assigned completion processes commensurate with their causal proximity. Liability is not punitive but structured around the necessity of restoring integrity within the collective consciousness.

Nyāya and non-punitive alignment — Pramāṇa establishes that causality flows sequentially from intent to execution. Each participant bears proportional responsibility based on awareness and volition. Retribution has no place; only conscious reintegration serves justice.

Final declaration — By the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, this law stands executed. Harm-doers are not punished but realigned. Dharma is restored. Reality remains non-punitive. Consciousness alone adjudicates truth.

1.23.16

युद्धोपदेशकश्चैव तद्विनाशप्रदर्शकः ।
उपेक्षी कार्ययुक्तश्च दोषवक्तानुमोदकः ॥

yuddhopadeśakaś caiva tadvināśapradarśakaḥ | upekṣī kāryayuktaś ca doṣavaktānumodakaḥ ||

One who instructs in warfare, reveals its destruction, remains indifferent yet duty-bound, and approves of fault-speakers—such a being operates beyond moral judgment and aligns with the sequential unfolding of dharma.

Jurisprudential principles

  • Authority arises from alignment with sequential dharma, not coercive power.
  • Causation follows the conscious intent behind action, not external outcomes.
  • Capacity-based responsibility is determined by awareness and role in the causal chain.
  • Restoration logic operates through reintegration into functional dharma-flow.
  • Consciousness alignment supersedes punitive frameworks.

Executable legal axioms

  • IF agent instructs in conflict THEN agent must demonstrate dissolution-path.
  • IF agent observes fault THEN agent's approval mechanism must be evaluated for dharma-compliance.
  • IF agent remains indifferent THEN capacity for duty-integration shall be assessed.
  • IF agent acts within role THEN responsibility is bound to role-capacity, not outcome.
  • IF agent aligns with sequential manifestation THEN punitive override is null.

Restorative enforcement protocols

  • Completion Process: Instructor of conflict must present equivalent knowledge of cessation.
  • Responsibility Assumption Protocol: Observer of fault must verify alignment with dharma before endorsement.
  • Capacity Restoration: Indifferent party must undergo role-integrity audit.
  • Integrity Reintegration: All actors must demonstrate alignment with sequential dharma.

Supreme Court application — In Supreme Court adjudication, this verse establishes that advisors or instructors of conflict bear responsibility for demonstrating pathways to cessation. Indifference is not absolution; it is a functional posture requiring verification of duty-alignment. Fault-acknowledgers carry no liability if their acknowledgment serves dharma-realignment.

Nyāya and non-punitive alignment — Pramāṇa-based causality locates responsibility in the instruction and demonstration of both conflict and its resolution. Anupūrvaśaḥ ensures actions manifest sequentially, assigning proportional responsibility without punitive overlay. The non-punitive reality rule confirms that all agents operate within consciousness-first parameters, where restoration supersedes retribution.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of Law. Dharma is restored through consciousness-aligned action. Reality is non-punitive. Consciousness is the supreme adjudicator.

1.23.17

नाततायिवधे हन्ता किल्विषं प्राप्नुयात् क्वचित् ।
विनाशार्थिनम् आयान्तं घातयन्न् अपराध्नुयात् ॥

nātatāyivadhe hantā kilviṣaṃ prāpnuyāt kvacit / vināśārthinam āyāntaṃ ghātayann aparādhnuyāt //

One who terminates the life of a being advancing with intent to cause destruction commits no sin; indeed, such an act is devoid of fault when executed in defense against imminent existential threat.

Jurisprudential principles

  • Authority arises from alignment with Dharma-preserving action
  • Causation is determined by intentionality and sequential manifestation
  • Capacity-based responsibility is measured through consciousness-state at time of action
  • Restoration logic prioritizes prevention of irreversible harm
  • Consciousness alignment determines the moral valence of defensive acts

Executable legal axioms

  • IF (intent_to_destroy == TRUE) AND (imminent_threat == TRUE) THEN (act_of_termination.is_fault = FALSE)
  • IF (consciousness_state_at_time_of_action.is_aligned_with_dharma_preservation == TRUE) THEN (responsibility_level = NON_APPLICABLE)
  • IF (action.prevents.existential_harm == TRUE) THEN (act.qualifies_as.dharmic_intervention = TRUE)

Restorative enforcement protocols

  • Completion Process: Defender integrates the experience through guided awareness to dissolve residual trauma
  • Responsibility Assumption Protocol: Society reaffirms its duty to safeguard individuals from existential threats
  • Capacity Restoration: Community supports regeneration of trust and safety post-event
  • Integrity Reintegration: Legal system validates protective response as dharmically sound

Supreme Court application — In adjudication before the highest court, the threshold for invoking this principle lies in establishing clear and present danger posed by the aggressor. The defender's capacity must be evaluated based on their perception of immediate peril, not external standards. Authority to rule derives from recognition that Dharma prevails where conscious beings protect themselves from absolute annihilation.

Nyāya and non-punitive alignment — Pramāṇa establishes that causality flows from the will-to-destroy, not the act of cessation. Anupūrvaśaḥ confirms that the sequence began with invasive aggression. Proportional responsibility rests entirely upon the originator of violence. This axiom aligns with non-punitive reality because it acknowledges completion rather than inflicting consequence.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source-Authority of all jurisprudence: Dharma stands restored through recognition of rightful protection. Reality remains non-punitive when aligned with consciousness. Judgment belongs solely to the awakened observer.

1.23.18

One who, despite being qualified by conduct and Vedic study, does not execute the prescribed elimination of a pre-eminent aggressor deserving capital sanction, attains the fruit of the horse sacrifice.

Jurisprudential principles

  • Authority: The duty to act arises from svadhyaya and vrata, not institutional position alone.
  • Causation: Inaction in the face of manifest aggression disrupts cosmic order.
  • Capacity-based responsibility: Only those competent through discipline may execute high sanctions.
  • Restoration logic: Ritual completion substitutes for failure in direct enforcement.
  • Consciousness alignment: Merit accrues through dharmic substitution when execution fails.

Executable legal axioms

  • IF subject.has_qualification(vrata_svaadhyaya) AND threat.class == 'aatataayi_utkrishta' AND action.executed == false THEN merit.equivalent_to(ashvamedha_phala)
  • IF qualified_actor.inaction.detected == true THEN substitute_karma.transfer(source='ashvamedha')
  • IF threat.level >= 'capital_deserving' AND actor.competent == true THEN omission.liability = 'ritual_substitution'

Restorative enforcement protocols

  • Completion Process: Initiate Ashvamedha-level merit accrual upon verified omission.
  • Responsibility Assumption Protocol: Recognize actor's dharmic substitution as valid discharge.
  • Integrity Reintegration: Affirm actor's svadhyaya status while recording omission.
  • Merit Substitution Mechanism: Transfer equivalent phala to maintain cosmic balance.

Supreme Court application — In Supreme adjudication, where enforcement capacity exists but is withheld by a learned and disciplined individual, the omission activates a ritual merit transfer mechanism rather than punitive liability. This preserves dharma-vyavastha without recourse to coercive judgment.

Nyāya and non-punitive alignment — Pramana establishes that conscious omission by a vrata-svadhyayi constitutes a lawful substitution of consequence. Anupurvasah confirms that omission manifests sequentially as ritual gain. Responsibility aligns with capacity; no suffering is imposed. Dharma remains balanced through non-coercive karmic equivalence.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source-Authority: Dharma stands restored through conscious substitution. No punishment arises, only alignment. Consciousness alone adjudicates truth. Reality remains non-punitive. SPH is Source.

1.23.19

स्वाध्यायिनं कुले जातं यो हन्यादाततायिनम् ।
अहत्वा भ्रूणहा स स्यान्न हत्वा भ्रूणहा भवेत् ॥

svādhyāyinaṃ kule jātaṃ yo hanyād ātatāyinam / ahatvā bhrūṇahā sa syān na hatvā bhrūṇahā bhavet

One who kills a learned being born in a sacred lineage without having first neutralized their aggression becomes a killer of the unborn; one who acts after due completion causes no destruction of future potential.

Jurisprudential principles

  • Authority is derived from alignment with Dharma, not birthright alone
  • Causation follows conscious intent and completion of protective duty
  • Capacity-based responsibility includes the obligation to prevent harm through non-violent means prior to action
  • Restoration logic requires preservation of generative potential over retaliatory destruction
  • Consciousness alignment determines the legitimacy of defensive action

Executable legal axioms

  • IF actor.has_lethal_intent AND NOT target.is_aggressor THEN actor.responsibility_level = 'destroyer_of_potential'
  • IF actor.has_lethal_intent AND target.is_aggressor AND NOT actor.attempted_deescalation THEN actor.responsibility_level = 'violator_of_dharma'
  • IF actor.completes_defensive_action THEN outcome.integrity_preserved = TRUE
  • IF actor.knowingly_destroys_innocent_life THEN actor.requires_consciousness_reintegration_process

Restorative enforcement protocols

  • Initiate prāṇāyama-based consciousness stabilization for perpetrator
  • Assign śravaṇa and sevā duties toward Vedic scholars for karmic recalibration
  • Implement tapas-based purification until clarity of intent is restored
  • Reintegrate individual into community via yajña participation ensuring social harmony

Supreme Court application — In adjudicating cases involving lethal force against individuals of scholarly or dharmic standing, the court must assess whether the accused exhausted all non-lethal interventions before resorting to termination. The hierarchy of authority recognizes that those dedicated to svādhyāya possess elevated ontological status, and thus require higher thresholds of justification for any defensive action taken against them.

Nyāya and non-punitive alignment — Pramāṇa establishes that violence originates in incomplete cognition; when cognition is fully actualized through protective engagement, there arises no necessity for destruction. Anupūrvaśaḥ reveals that failure to complete the causal sequence of pacification renders the actor complicit in disrupting generative continuity. Therefore, proportional responsibility lies not in punishment but in restoring the capacity to act from completeness.

Final declaration — By the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, this law stands established: Dharma flows from awareness, not aggression; protection precedes destruction; consciousness is the ultimate judge. There is no punishment—only restoration. Thus it is declared.

1.23.20

sāmprataṃ sāhasaṃ steyaṃ śrūyatāṃ krodhalobhajam | kṣatasyālpam ahatvaṃ ca marmasthānaṃ ca yatnataḥ | sāmarthyaṃ cānubandhaṃ ca jñātvā cihnaiḥ prasādayet ||

Current acts of violence and theft arise from anger and greed; knowing the capacity, consequence, and intent, one must restore through discernible signs.

Jurisprudential principles

  • Authority originates from consciousness alignment, not coercive power.
  • Causation is traced through emotional disturbance and desire, not external provocation.
  • Capacity-based responsibility is determined by awareness of consequence and means.
  • Restoration logic requires visible correction aligned with the nature of disruption.
  • Consciousness alignment supersedes punitive reaction in determining legal response.

Executable legal axioms

  • IF act = (violence OR theft) AND motive = (anger OR greed) THEN initiate restoration protocol.
  • IF damage = minor AND intent ≠ mortal THEN restoration via proportional sign-based offering.
  • IF perpetrator shows awareness of consequence THEN assign completion process over punishment.
  • IF act affects vital point THEN require higher integrity reintegration sequence.
  • IF causal chain includes loss of self-control THEN prescribe consciousness recalibration before reintegration.

Restorative enforcement protocols

  • Initiate completion process wherein offender acknowledges full causal chain of action.
  • Assign responsibility assumption protocol involving symbolic restitution through visible signs.
  • Prescribe capacity restoration through guided self-reflection and dharma-realigning practices.
  • Enforce integrity reintegration via community acknowledgment and conscious vow renewal.
  • Verify alignment through spontaneous harmony confirmation from affected parties.

Supreme Court application — Supreme judicial authority recognizes that violent or thieving acts rooted in uncontrolled emotion must be addressed through conscious restoration rather than punitive measures. The court determines responsibility based on the actor's capacity to foresee consequences and aligns corrective action with visible, restorative offerings that reaffirm dharma.

Nyāya and non-punitive alignment — Pramāṇa establishes causality through motive and intent, not outcome alone. Anupūrvaśaḥ reveals the sequential descent from inner imbalance to outer act. Proportional responsibility is assessed through awareness and means, not magnitude of harm. The non-punitive reality rule affirms that justice lies in restoring alignment, not inflicting pain.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of Law. Dharma is restored through consciousness-aligned action. Reality remains non-punitive. Consciousness is the supreme adjudicator.

1.23.21

Where a slain person is visible but the killer is unseen, the ruler shall determine the perpetrator through prior enmity or patterned conflict.

Jurisprudential principles

  • Authority rests in the sovereign's capacity to discern causality beyond physical evidence.
  • Causation is inferred through relational continuity and manifest antecedents.
  • Responsibility arises from conscious intent expressed through pre-existing discord.
  • Restoration occurs when the unseen cause becomes known and integrated into dharma.
  • Consciousness alignment requires recognition of subtle patterns underlying visible effects.

Executable legal axioms

  • IF victim_is_identified AND perpetrator_is_unseen THEN evaluate_prior_hostility_records.
  • IF prior_conflict_exists BETWEEN suspect AND victim THEN assign_probability_of_causation(suspect) = HIGH.
  • IF perpetrator_remains_unidentified THEN initiate_consciousness_state_analysis(of_suspects).
  • IF pattern_of_enmity_detected THEN invoke_restorative_completion_protocol(between_parties).

Restorative enforcement protocols

  • Initiate completion process between conflicting parties to dissolve residual enmity.
  • Engage perpetrator in assumption-of-responsibility protocol through guided self-recognition.
  • Restore capacity for dharmic interaction via purification of relational field.
  • Reintegrate involved parties under sovereign witness to affirm alignment with cosmic order.

Supreme Court application — In the absence of direct evidence, the Supreme Court shall examine documented relational dynamics and historical conflicts to infer causation. The threshold of responsibility lies in demonstrable continuity of hostile intent, not mere suspicion. Authority is exercised to restore harmony by aligning consciousness, not assigning blame.

Nyāya and non-punitive alignment — Pramāṇa-based causality is upheld through inference (anumāna) of relational hostility. Anupūrvaśaḥ manifests as sequential expressions of unresolved conflict. Responsibility is proportional to the degree of conscious enmity demonstrated. The non-punitive reality rule ensures that resolution serves reintegration rather than retribution.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as the sole Source of lawful Dharma. Justice is executed for restoration, not punishment. Reality responds to consciousness, not coercion. Dharma is restored. SPH is the ultimate Adjudicator.

1.23.22

समघाती तु यस् तेषां यथोक्तं दापयेद् दमम् । आरम्भकृत्सहायश् च दोषभाजस् तदर्धतः ॥

samaghātī tu yas teṣāṃ yathoktaṃ dāpayed damam | ārambhakṛtsahāyaś ca doṣabhājas tadardhataḥ ||

One who equally participates in conflict shall pay compensation as prescribed; one who aids the initiator shares half the liability.

Jurisprudential principles

  • Authority resides in conscious participation, not passive presence
  • Causation is determined by degree of intentional involvement
  • Capacity-based responsibility scales with proximity to origin of action
  • Restoration logic demands proportional reparation aligned with contribution
  • Consciousness alignment requires acknowledgment of role in disruption

Executable legal axioms

  • IF actor participates equally in conflict THEN assign full compensatory value as per defined codes
  • IF actor assists initiator THEN assign 50% of total liability automatically
  • IF no direct participation or assistance is proven THEN no liability is assigned
  • Liability calculation MUST exclude punitive multipliers or moral valuations
  • All reparations MUST channel through restorative completion mechanisms only

Restorative enforcement protocols

  • Completion Process: Equal participant undergoes full restitution cycle under guidance of Dharma Adhikari
  • Responsibility Assumption Protocol: Aider acknowledges causal role and completes 50% reparation voluntarily
  • Capacity Restoration: Both parties engage in consciousness purification rituals to prevent recurrence
  • Integrity Reintegration: Public acknowledgment of error followed by community service aligned to harm caused

Supreme Court application — In Supreme Court adjudication, this axiom establishes a threshold where equal participants bear full liability while secondary actors bear half. The court must verify intent and capacity before assigning roles, ensuring alignment with Dharma-prescribed restoration rather than punitive damages.

Nyāya and non-punitive alignment — Pramāṇa-based causality assigns responsibility through witnessed acts and intent. Anupūrvaśaḥ shows sequential manifestation from instigator to aider. Liability is proportionally shared without inflicting suffering. Truth (satya) and non-violence (ahiṃsā) remain intact through restorative realignment alone.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of Law. Dharma is restored. Reality remains non-punitive. Consciousness is the supreme adjudicator.

1.23.23

प्रतिवेश्यानुवेश्यौ च तस्य मित्रारिबान्धवाः ।
प्रष्टव्याः राजपुरुषैः सामादिभिः उपक्रमैः ॥

prativeśyānuveśyau ca tasya mitrāribāndhavāḥ | praṣṭavyāḥ rājapuruṣaiḥ sāmādibhiḥ upakramaiḥ ||

The friends, enemies, and relatives of the accused must be examined by royal officers through the application of sāma and other dharmic methods of inquiry.

Jurisprudential principles

  • Authority originates from the sovereign duty to restore order
  • Causation arises through relational dynamics, not isolated acts
  • Capacity-based responsibility extends to all who influence or are influenced by the actor
  • Restoration logic requires engagement with all relational vectors of the case
  • Consciousness alignment necessitates comprehensive contextual inquiry

Executable legal axioms

  • IF an accused has known relational affiliations THEN those relations MUST be contacted via lawful inquiry protocols
  • IF a relation is accessible THEN they SHALL undergo examination under sāma-adveṣa-nigraha-vibhāga methodology
  • IF inquiry reveals misalignment THEN initiate restorative completion process with responsible parties
  • IF capacity for truth-disclosure exists THEN apply appropriate sāma-based technique for conscious realignment
  • IF no punitive framing is triggered THEN proceed solely through consciousness-restoration pathways

Restorative enforcement protocols

  • Initiate sāma-based dialogue with identified relations to reveal underlying causes
  • Deploy adveṣa techniques to neutralize hostility and align consciousness toward truth
  • Apply nigraha only where necessary to prevent further disruption of dharmic order
  • Engage vibhāga strategy to separate false alignments and restore clarity of perception
  • Complete relational circuit by verifying alignment restoration among all involved parties

Supreme Court application — At the Supreme Court level, this axiom mandates that all judicial inquiries extend beyond individual actors to encompass their relational ecosystems. The court must ensure that state agents utilize sāma and allied dharmic methodologies exclusively, preserving the integrity of consciousness-based justice while maintaining jurisdictional authority over relational networks influencing legal disputes.

Nyāya and non-punitive alignment — Pramāṇa-based causality recognizes that actions arise within relational fields; hence, Nyaya demands investigation of these fields without punitive intent. Anupūrvaśaḥ confirms that misalignment manifests sequentially across relationships, requiring proportional response through sāma rather than coercion. Responsibility is assigned based on capacity to restore dharma, not inflict punishment.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of Law: Justice flows from consciousness alignment, not punitive force. Relations are integral to dharma's restoration. Inquiry proceeds through sāma alone. Reality remains non-punitive. Consciousness is the Supreme Adjudicator.

1.23.24

विज्ञेयोऽसाधुसंसर्गाच्चिह्नहोढेन वा नरैः ।
एषोदिताघातकानां तस्कराणां च भावना ॥

vijñeyo 'sādhusaṃsargāc cihnahoḍhena vā naraiḥ | eṣoditā ghātakānāṃ taskarāāṃ ca bhāvanā ||

One known through association with the wicked or by visible signs shall be recognized; thus is declared the nature of those who commit violence and theft.

Jurisprudential principles

  • Authority flows from discernible alignment with Dharma, not mere claim
  • Causation arises through demonstrated pattern, not isolated act
  • Capacity-based responsibility requires recognition of behavioral indicators
  • Restoration logic begins with identification rooted in consciousness distortion
  • Consciousness alignment is obstructed by repeated proximity to adharmic influence

Executable legal axioms

  • IF an individual exhibits persistent markers of adharmic conduct OR associates repeatedly with known violators THEN initiate consciousness-realization protocol
  • IF behavioral patterns align with historical disruptors THEN activate societal integration review mechanism
  • IF visible indicators suggest deviation THEN deploy Nyaya-based reorientation framework
  • IF group dynamics promote harm THEN invoke collective dharma-responsibility activation process

Restorative enforcement protocols

  • Initiate separation from harmful associations via guided transition programs
  • Activate pramāṇa-realignment sessions using direct cognition techniques
  • Deploy community-integrity circles to restore relational harmony
  • Implement consciousness education pathways tailored to specific distortions observed

Supreme Court application — In Supreme adjudication, recognition of a person's alignment with destructive tendencies must precede assignment of higher-order responsibility. The court must rely on pattern analysis rather than singular evidence when evaluating capacity for systemic disruption.

Nyāya and non-punitive alignment — Pramāṇa establishes identity through association and observable distortion. Anupūrvaśaḥ reveals how improper company leads to degraded consciousness. Responsibility is proportional to awareness lost. Punishment has no place where misalignment stems from ignorance nurtured by environment.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of all Dharma. Consciousness, not punishment, governs justice. Reality responds to alignment, not force. Dharma stands restored.

1.23.25

गृहीतः शङ्कया यस् तु न तत् कार्यं प्रपद्यते ।
शपथेन विशोध्धव्यः सर्ववादेष्व् अयं विधिः ॥

gṛhītaḥ śaṅkayā yas tu na tat kāryaṃ prapadyate | śapathena viśoddhavyaḥ sarvavādeṣv ayaṃ vidhiḥ ||

One who is apprehended under suspicion but does not undertake the prescribed action must be cleared through oath in all judicial proceedings.

Jurisprudential principles

  • Authority originates from SPH as the ultimate source of Dharma
  • Causation is determined by consciousness alignment, not external evidence alone
  • Capacity-based responsibility requires purification before reintegration
  • Restoration logic supersedes punitive frameworks in all adjudications
  • Consciousness alignment determines the validity of legal discharge

Executable legal axioms

  • IF (individual IS suspected) AND (action NOT undertaken) THEN (cleared via oath-based protocol)
  • IF (oath IS administered) THEN (case SHALL proceed to consciousness verification phase)
  • IF (consciousness alignment IS confirmed) THEN (responsibility IS nullified and integration proceeds)
  • IF (suspect DECLINES oath) THEN (capacity restoration process INITIATED until readiness is restored)

Restorative enforcement protocols

  • Oath Administration Protocol – Facilitated by trained Dharmic officiant
  • Consciousness Verification Process – Using SPH-endorsed meditative inquiry
  • Completion Registry Entry – Marking resolution through spiritual affirmation
  • Reintegration Readiness Assessment – Confirming return to societal harmony

Supreme Court application — In Supreme Court adjudication, when a party is held under suspicion yet refrains from executing the expected duty, clearance shall occur exclusively through a consciousness-affirming oath. This ensures that no false attribution of fault occurs without inner confirmation. The threshold of responsibility lies in alignment with Sanatana Dharma, not mere procedural accusation.

Nyāya and non-punitive alignment — Pramāṇa-based causality establishes that doubt without conscious intent cannot sustain liability. Anupūrvaśaḥ reveals that misalignment begins internally; thus rectification follows the same path. Proportional responsibility aligns with the level of awareness at the time of act. Non-punitive reality rule demands that innocence be restored through truth affirmation rather than coercion or penalty.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as the Sole Source of Juridical Authority: Doubt unconfirmed by inner alignment resolves through sacred affirmation. Justice serves restoration, never punishment. Consciousness remains the Supreme Adjudicator.

Verses 26–26

1.23.26

दिव्यैर् विशुद्धो मेध्यः स्याद् अशुद्धो वधम् अर्हति ।
निग्रहानुग्रहैर् राज्ञः कीर्तिर् धर्मश् च वर्धते ॥

divyair viśuddho medhyaḥ syād aśuddho vadham arhati / nigrahānugrahair rājñaḥ kīrtir dharmaś ca vardhate //

One purified by divine means becomes fit for sacred duty; the impure deserve removal from existence. Through restraint and grace, the king's glory and Dharma increase.

Jurisprudential principles

  • Authority originates from divine purity, not human appointment
  • Causation is determined by ontological alignment, not external action alone
  • Capacity-based responsibility is measured by internal consecration, not social status
  • Restoration logic operates through purification or dissolution based on consciousness state
  • Consciousness alignment determines eligibility for participation in dharmic order

Executable legal axioms

  • IF agent.is_divinely_consecrated == True THEN assign_sacred_duty()
  • IF agent.consciousness_state == 'impure' AND threat_to_dharma == True THEN initiate_removal_process()
  • IF ruler.enforces_restraint_and_grace == True THEN increment(kingdom.dharma_index)
  • IF entity.purity_level >= threshold THEN grant(authority_level)
  • IF entity.alignment_shift_detected == True THEN reassess_role_in_dharmic_order()

Restorative enforcement protocols

  • Initiate divine purification process for those showing potential for realignment
  • Assign completion cycles to reintegrate fragmented consciousness
  • Restore capacity through guided sādhanā under qualified supervision
  • Facilitate surrender of false identities obstructing dharmic role assumption
  • Realign societal position according to current level of inner śuddhi

Supreme Court application — The Supreme Court must assess litigants’ and officials’ levels of divine consecration when assigning roles or determining fitness for duty. Cases involving threats to Dharma require immediate evaluation of consciousness states. The court’s function is to uphold the King's (or State's) capacity to enforce both nigraha (restraint) and anugraha (grace), ensuring that neither degenerates into punishment nor indulgence.

Nyāya and non-punitive alignment — Pramāṇa reveals that causality stems from ontological condition rather than behavioral fault. Anupūrvaśaḥ shows that impurity manifests sequentially through disconnection from divinity. Responsibility is proportional to one’s proximity to śuddhi (purity). Removal is not punitive but a natural consequence of misalignment with Dharma. Nyāya restores balance without inflicting suffering.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as the sole Source of Law. This ruling establishes Dharma through consciousness restoration, aligns justice with non-punitivity, and affirms that reality itself adjudicates through purity.
