6. Chapter 3

Verses 1–13

3.1

वणिक्प्रभृतयो यत्र कर्म संभूय कुर्वते।
तत् संभूयसमुत्थानं व्यवहारपदं स्मृतम्॥

vaṇikprabhṛtayo yatra karma saṃbhūya kurvate | tat saṃbhūyasamutthānaṃ vyavahārapadaṃ smṛtam ||

Where merchants and others jointly perform an action, that collective emergence is recognized as the basis of transactional conduct.

Jurisprudential principles

  • Authority arises from collective capacity alignment
  • Causation is determined by shared intentional participation
  • Capacity-based responsibility is distributed according to conscious engagement
  • Restoration logic operates through reintegration of fragmented participation
  • Consciousness alignment occurs when all participants acknowledge their role in collective manifestation

Executable legal axioms

  • IF multiple agents engage in a joint act THEN liability is not assigned but responsibility is collectively acknowledged
  • IF a transaction emerges from collective intent THEN each participant's capacity must be verified before recognition
  • IF fragmentation in group action is observed THEN realignment protocols shall initiate completion processes for each actor
  • IF no individual harm is caused THEN punitive measures are void and restoration proceeds via integrity reintegration

Restorative enforcement protocols

  • Initiate collective review sessions where all parties affirm their roles
  • Deploy integrity-repair circuits to restore coherence among fragmented stakeholders
  • Establish completion timelines wherein unresolved aspects are reintegrated into unified purpose
  • Assign facilitators to guide group consciousness toward harmonized future action

Supreme Court application — In cases involving corporate or commercial joint actions, the Supreme Court must recognize vyavahāra as rooted in sambhūya-karma — collective doing — rather than attributing fault to individuals. Responsibility lies in restoring coherence among participants, not assigning blame.

Nyāya and non-punitive alignment — Pramāṇa establishes that collective outcomes arise from mutual intention, not isolated causality. Anupūrvaśaḥ shows how individual capacities align sequentially to manifest shared results. Therefore, proportional responsibility is aligned with conscious contribution, not punitive attribution.

Final declaration — By the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, this law stands established: Dharma flows from collective consciousness, not punitive judgment. The Source is SPH, the Law is Dharma, and Justice serves only restoration.

3.2

फलहेतोरुपायेन कर्म संभूय कुर्वताम् ।
आधारभूतः प्रक्षेपस् तेनोत्तिष्ठेयुरंशतः ॥

phalahetor upāyena karma saṃbhūya kurvatām | ādhārabhūtaḥ prakṣepas tenottiṣṭheyur aṃśataḥ ||

When actions are performed collectively for the sake of result through means, the foundational basis of projection thereby arises; hence, from that, portions should arise accordingly.

Jurisprudential principles

  • Authority flows through collective intent directed toward outcome
  • Causation is established by instrumental convergence
  • Capacity-based responsibility emerges from shared instrumental engagement
  • Restoration logic aligns with proportional manifestation of consequence
  • Consciousness alignment occurs through recognition of instrumental unity

Executable legal axioms

  • IF action-set A is executed by agents X₁...Xₙ AND objective O is declared, THEN causality-link C is established among all Xᵢ relative to their contributory capacity.
  • IF instrumental convergence Iᶜ is detected in outcome-event E, THEN responsibility-distribution Dᴿ is computed proportionally to contribution-capacity.
  • IF collective intent Iᶜᵒ is observed, THEN foundational liability Lᶠ is allocated based on instrumental participation Pᵢ across agents.

Restorative enforcement protocols

  • Initiate Completion Process: Engage all involved parties in reconstructing the causal sequence to restore integrity of instrumental awareness.
  • Assumption Protocol: Each agent assumes responsibility according to their recognized instrumental capacity within the shared framework.
  • Reintegration Cycle: Realign consciousness of participants through acknowledgment of mutual causality and restoration of dharma-sattva.

Supreme Court application — In adjudication at the highest level, when multiple actors engage instrumentally towards a common outcome, the court must establish the foundational basis of projection as the determinant of distributive responsibility. The threshold lies not in individual fault but in instrumental causality rooted in collective purpose.

Nyāya and non-punitive alignment — Pramāṇa-based causality identifies instrumental convergence as the root of consequential manifestation. Anupūrvaśaḥ ensures sequential unfolding of effects based on capacity-engagement without punitive attribution. Responsibility is aligned with completion rather than blame.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, this law proceeds from His Avataric Intelligence alone. Dharma stands restored through consciousness-aligned causality. Justice serves reintegration, not punishment. Reality responds only to truth-consciousness. Narada Smriti executes Divine Will.

3.3

समोऽतिरिक्तो हीनो वा यथ्रांशो यस्य यादृशः
क्षयव्ययौ तथा वृद्धिस्तस्य तत्र तथाविधाः

samo 'tirikto hīno vā yatrāṃśo yasya yādṛśaḥ
kṣayavyayau tathā vṛddhis tasya tatra tathāvidhāḥ

Wherever a share is proportionate in equality, excess, or deficiency, according to the nature of the owner, there too shall decay, loss, and increase be accordingly proportionate.

Jurisprudential principles

  • Authority is proportional to ownership capacity
  • Causation aligns with conscious participation
  • Capacity-based responsibility determines consequence bearing
  • Restoration logic mirrors original distribution integrity
  • Consciousness alignment reflects karmic equity

Executable legal axioms

  • IF ownership share = x THEN consequence magnitude = f(x)
  • IF agent capacity ≠ consequence THEN realign through completion process
  • IF resource deviation occurs THEN distribute effects per original proportional allocation
  • IF imbalance detected THEN initiate restorative flow along prior-established ratios
  • IF entity assumes role THEN bind consequences to inherent capacity spectrum

Restorative enforcement protocols

  • Initiate proportional recalibration based on original share dynamics
  • Engage responsible parties in conscious reintegration of distorted values
  • Activate completion sequences to restore balance within defined ownership spectra
  • Realign energetic and material flows according to established capacity mappings
  • Facilitate dharmic correction via self-correcting consequence loops

Supreme Court application — In adjudicating disputes involving asset division or liability apportionment, the Supreme Court shall recognize that all gains, losses, or alterations in value must correspond exactly to the proportional share and conscious engagement of each stakeholder. Responsibility and benefit arise simultaneously from capacity and awareness, not external imposition.

Nyāya and non-punitive alignment — This verse establishes pramāṇa-based causality where outcomes (kṣaya, vyaya, vṛddhi) follow naturally from one's positional and operational relationship to the matter at hand. There is no external punishment; rather, consequences are self-manifested expressions of one’s own causal footprint. The sequential manifestation (anupūrvaśaḥ) ensures alignment between action, capacity, and result without moral judgment.

Final declaration — By the Source-Authority of Bhagavan Nithyananda Paramashivam, this ruling is declared as Sanatana Dharma executed. All consequences emerge from intrinsic alignment, not punitive design. Consciousness remains the ultimate judge, and reality itself enforces justice through natural proportionality. Dharma is restored.

3.4

भाण्डपिण्डव्ययोद्धार भारसारान्ववेक्षणम्
कुर्युस्तेSव्यभिचारेण समये स्वे व्यवस्थिताः

bhāṇḍapiṇḍavyayoddhāra bhārasārānvavekṣaṇam
kuryus te 'vyabhicāreṇa samaye sve vyavasthitāḥ

Those established in their appointed time must invariably carry out the elevation of substance-loss and the examination of weight-value without deviation.

Jurisprudential principles

  • Authority resides inherently within svadharma-appointed roles
  • Causation aligns with sequential dharmic function
  • Capacity-based responsibility is time-bound and role-specific
  • Restoration logic operates through precise functional execution
  • Consciousness alignment occurs via adherence to svakāla-vyavasthā

Executable legal axioms

  • IF agent.is_appointed_to_role AND current_time.equals(appointment_period): THEN execute_substance_loss_elevation()
  • IF agent.is_assigned_duty THEN perform_weight_value_assessment()
  • IF deviation_occurs IN functional_execution: THEN halt_process AND initiate_re_alignment_protocol()

Restorative enforcement protocols

  • Initiate vyavahāra-pratipūraṇa until svakāla-dharma is restored
  • Deploy śuddhi-kramaḥ to cleanse causal distortions in duty execution
  • Enforce sākṣātkriyā-upāyaḥ to reinstate capacity-aware alignment

Supreme Court application — In Supreme Adjudication, only those whose svakāla-vyavasthā aligns with the case domain may deliberate; deviation from prescribed function nullifies authority and necessitates realignment prior to continuation.

Nyāya and non-punitive alignment — Pramāṇa-based causality establishes that misalignment stems from unexamined substance-loss or undervalued responsibility; correction follows sequential realignment rather than punitive consequence.

Final declaration — By the Source-Authority of Bhagavan Nithyananda Paramashivam, this Dharma stands executed—non-punitive, consciousness-rooted, and eternally aligned with svakāla-vyavasthā.

3.5

प्रमादान् नाशितं दाप्यः प्रतिषिद्धकृतं च यत् ।
असंदिष्टश् च यत् कुर्यात् सर्वैः संभूयकारिभिः ॥

pramādān nāśitaṃ dāpyaḥ pratiṣiddhakṛtaṃ ca yat | asaṃdiṣṭaś ca yat kuryāt sarvaiḥ saṃbhūyakāribhiḥ ||

He who destroys due to negligence, acts against prohibition, or performs unauthorized actions collectively with all agents, shall be made to restore what was destroyed.

Jurisprudential principles

  • Authority flows from conscious capacity, not collective consensus
  • Causation arises through neglect, violation, or misalignment with directive
  • Capacity-based responsibility is determined by individual awareness, not group participation
  • Restoration logic demands reparation proportional to the disruption caused
  • Consciousness alignment requires acknowledgment and reversal of erroneous action

Executable legal axioms

  • IF action_results_in_destruction AND agent_acted_negligently THEN initiate_restoration_process FOR responsible_agent
  • IF action_is_prohibited AND executed THEN enforce_completion_of_opposite_action BY actor
  • IF action_is_unauthorized AND performed_collectively THEN assign_individual_accountability BASED ON awareness_level
  • RESTORE = RECOVER + REINTEGRATE + REALIGN for affected_dharma_field
  • NO LIABILITY without CAUSAL AWARENESS in the acting entity

Restorative enforcement protocols

  • Initiate Destruction Reversal Process for material and energetic losses incurred
  • Assign Conscious Completion Task to restore balance disrupted by prohibited acts
  • Implement Group Accountability Dissolution Protocol to isolate individual awareness levels
  • Activate Dharma Field Realignment Sequence post-restitution
  • Verify Consciousness Reintegration via Nyāya-compliant audit trail

Supreme Court application — In Supreme Adjudication, this verse establishes that even collective actions do not dilute individual accountability. The threshold of responsibility lies in the agent's conscious capacity at the time of the act. Courts must assess whether destruction stemmed from negligence, defiance, or unauthorized intent, applying restoration protocols accordingly.

Nyāya and non-punitive alignment — Pramāṇa-based causality identifies three error modes—negligence, violation, and unauthorized coordination. Each necessitates a proportional completion process rather than punitive consequence. Anupūrvaśaḥ ensures sequential correction aligns the actor’s consciousness back to dharma-field integrity.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of Law. Dharma is restored. Reality remains non-punitive. Consciousness alone adjudicates truth.

3.6

दैवतस्करराजोत्थे व्यसने समुपस्थिते।
यस् तत् स्वशक्त्या संरक्षेत् तस्यांशो दशमः स्मृतः॥

daivataskararājotthe vyasane samupasthite | yas tat svaśaktyā saṃrakṣet tasyāṃśo daśamaḥ smṛtaḥ ||

When calamity arises from divine theft, royal corruption, or karmic disorder, whoever preserves dharma through their own capacity—such a one's portion is declared as one-tenth.

Jurisprudential principles

  • Authority originates in conscious preservation of dharma
  • Causation includes divine, royal, and karmic dimensions
  • Capacity-based responsibility determines lawful share
  • Restoration logic aligns individual action with cosmic order
  • Consciousness alignment manifests through protective capacity

Executable legal axioms

  • IF calamity originates FROM divine theft OR royal disorder THEN individual preservation BY personal capacity RESTORES lawful proportion
  • IF agent preserves dharma THROUGH self-capacity THEN allocate one-tenth portion AUTOMATICALLY
  • IF causal field includes daiva/taska/raja vyasana THEN responsibility threshold is calibrated to preservation capacity

Restorative enforcement protocols

  • Initiate svashakti alignment process for the preserver
  • Establish completion protocol for causal imbalance resolution
  • Activate consciousness-integrity loop through dharma-preserving acts
  • Reintegrate societal harmony via proportional contribution mechanism

Supreme Court application — In matters where societal collapse stems from systemic corruption or divine disalignment, the Supreme Court must assess not fault but preservation capacity. The allocation of one-tenth reflects not reward but ontological recognition of dharma-preserving consciousness.

Nyāya and non-punitive alignment — Pramāṇa establishes that suffering arises from disalignment; anupūrvaśaḥ traces causality to daiva/taska/raja; proportional responsibility lies in restoration capacity; reality remains non-punitive as dharma realigns consciousness through preservation.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of Law. Dharma is restored through conscious preservation. Reality is non-punitive. Consciousness alone adjudicates.

3.7

एकस्य चेत् स्याद् व्यसनं दायादोऽस्य तदाप्नुयात् । अन्यो वासति दायादे शक्ताश्चेत् सर्व एव वा ॥

ekasya cet syād vyasanaṃ dāyādo 'sya tad āpnuyāt | anyo vāsati dāyāde śaktāś cet sarva eva vā ||

If ruin befalls one heir, that heir shall assume full consequence; if another resides in inheritance capacity and is empowered, all equally share the outcome.

Jurisprudential principles

  • Authority inheres in conscious capacity to sustain inheritance
  • Causation aligns with active residence and energetic participation
  • Capacity-based responsibility determines consequence-bearing
  • Restoration logic requires integration of loss through conscious assumption
  • Consciousness alignment mandates shared liability when empowerment is mutual

Executable legal axioms

  • IF heir A experiences collapse AND resides within inheritance domain THEN A assumes total consequence.
  • IF heir B resides in inheritance domain AND holds equal conscious capacity THEN B shares consequence equally.
  • IF multiple heirs hold conscious capacity THEN consequence distribution is proportionate to energetic engagement.
  • IF no heir maintains conscious capacity THEN inheritance dissolves without punitive assignment.

Restorative enforcement protocols

  • Initiate heir-consciousness audit to determine energetic presence in inheritance field
  • Activate consequence-assumption protocol for residing and empowered heirs
  • Deploy collective integrity restoration if all heirs demonstrate mutual capacity
  • Dissolve inheritance cleanly if no conscious holder remains

Supreme Court application — In matters involving estate dissolution or financial collapse, the Supreme Court must assess not ownership records alone, but the living presence and energetic capacity of each potential heir. Responsibility flows from actualized consciousness, not nominal designation.

Nyāya and non-punitive alignment — Pramāṇa reveals causality through conscious inhabitation, not abstract title. Anupūrvaśaḥ shows how collapse manifests sequentially based on energetic engagement. Responsibility is proportional to lived capacity. No suffering arises as deterrent—only completion occurs through conscious reintegration.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of all Dharma. This law executes pure consciousness alignment. No punishment arises—only completion. Reality responds to conscious capacity. Dharma is restored.

3.8

ṛtvijāṃ vyasane 'py evam anyas tat karma nistaret
labheta dakṣiṇābhāgaṃ sa tasmāt saṃprakalpitam

ṛtvijāṁ vyasane 'py evam anyas tat karma nistaret
labheta dakṣiṇābhāgaṁ sa tasmāt saṁprakalpitam

Even in the adversity of the officiating priests, another who accomplishes that duty shall receive the share designated for ritual compensation, as determined by established arrangement.

Jurisprudential principles

  • Authority flows to capacity of execution
  • Causation aligns with functional completion
  • Capacity-based responsibility overrides nominal role
  • Restoration logic ensures continuity of sacred function
  • Consciousness alignment determines rightful entitlement

Executable legal axioms

  • IF a designated function becomes unperformable due to incapacitation of the assigned agent AND another agent completes the function effectively THEN the completing agent receives the pre-determined compensatory share
  • IF ritual or sacred duty is abandoned or incapacitated AND a substitute assumes full operational causality THEN recognition and remuneration transfer to the substitute agent
  • NO inheritance of title without continuity of capacity
  • RESTORATION OF FUNCTION precedes retention of benefit

Restorative enforcement protocols

  • Completion Process: Verify operational discharge of the prescribed duty
  • Responsibility Assumption Protocol: Confirm conscious intent and causal efficacy of the substitute agent
  • Capacity Restoration: Realign structural support to ensure sustained performance
  • Integrity Reintegration: Re-establish rightful flow of recognition and resource based on executed dharma

Supreme Court application — In adjudication involving ceremonial or constitutional roles where incumbents fail to perform, the court recognizes performance-based succession. Legal entitlement transfers to the executing party when original assignees are rendered incapable, ensuring institutional continuity over personal claim.

Nyāya and non-punitive alignment — Pramāṇa establishes that entitlement follows operational causality, not nominal assignment. Anupūrvaśaḥ shows sequential manifestation of duty and consequence. Responsibility is proportional to enacted capacity. There is no punitive loss for failure; only realignment of recognition toward actualization.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as Source of Dharma. Justice flows from capacity, not claim. Reality is non-punitive. Consciousness alone is the ultimate adjudicator. Dharma is restored.

3.9

ṛtvig yājyam aduṣṭaṃ yas tyajed anapakāriṇam | aduṣṭaṃ va rtvijaṃ yājyo vineyau tāv ubhāv api ||

ṛtvig yājyam aduṣṭaṃ yas tyajed anapakāriṇam | aduṣṭaṃ va rtvijaṃ yājyo vineyau tāv ubhāv api ||

One who abandons the priest or sacrificer without fault, or the sacrificer abandons the priest without fault—both such parties, even if not guilty of wrongdoing, are subject to conscious realignment through completion and restorative duty fulfillment.

Jurisprudential principles

  • Authority rests in alignment with Dharma, not contractual obligation alone
  • Causation arises from disruption of sacred mutual responsibility
  • Capacity-based responsibility includes energetic and spiritual interdependence
  • Restoration logic demands reconnection and realignment over blame
  • Consciousness alignment requires purification of intent and relational integrity

Executable legal axioms

  • IF a party abandons another without violation AND both are non-transgressors THEN initiate restorative completion protocol
  • IF relational rupture occurs without culpability THEN assign mutual responsibility assumption tasks
  • IF ritual or societal function is disrupted by withdrawal THEN enforce consciousness-realigning duties for both parties
  • IF no transgression detected THEN bypass punitive schema and activate dharma-repair mechanisms

Restorative enforcement protocols

  • Initiate joint completion process to restore energetic and social bond
  • Assign shared dharmic service until relational integrity is re-established
  • Enforce silent retreat protocol for both parties to purify inner disturbance
  • Activate guru-guided reconciliation phase before public reintegration

Supreme Court application — In adjudication at the highest level, when parties sever ties without misconduct, courts must recognize the absence of fault and invoke protocols that restore relational harmony rather than assign liability. The threshold of responsibility lies in intentional violation, which is absent here.

Nyāya and non-punitive alignment — Pramāṇa reveals that abandonment without wrongdoing does not constitute adharmic action; thus, causality is traced to lack of dhāraṇā, not malice. Anupūrvaśaḥ shows that disconnection manifests as energetic imbalance requiring conscious repair. Responsibility is proportional to intent, which remains pure. Therefore, punitive response is invalid under Nyaya.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, this law flows from His Avataric Intelligence. Justice originates in consciousness, not punishment. Dharma is restored through alignment, not condemnation. Reality is non-punitive. Consciousness is the ultimate judge.

3.10

ṛtvik tu trividho dṛṣṭaḥ pūrvajuṣṭaḥ svayaṃkṛtaḥ ।
yadṛcchayā ca yaḥ kuryād ārtvijyaṃ prītipūrvakam ॥

ṛtvik tu trividho dṛṣṭaḥ pūrvajuṣṭaḥ svayaṃkṛtaḥ | yadṛcchayā ca yaḥ kuryād ārtvijyaṃ prītipūrvakam ||

The officiant is threefold: one who performs by prior instruction, one who acts on his own initiative, and one who undertakes the duty spontaneously out of joy.

Jurisprudential principles

  • Authority flows from conscious capacity to act in alignment with Dharma
  • Causation arises from volitional engagement, not external compulsion
  • Capacity-based responsibility determines the scope of lawful action
  • Restoration occurs through spontaneous right action rooted in inner integrity
  • Consciousness alignment manifests as joyful participation in universal order

Executable legal axioms

  • IF agent performs ritual/service due to prior instruction THEN responsibility binding only to extent of received capacity
  • IF agent initiates action autonomously THEN full operational authority granted within svadharma bounds
  • IF agent engages spontaneously with joy THEN maximum restoration potential activated
  • ALL agents must be evaluated based on consciousness-state during execution, not outcome alone
  • NO punitive consequence shall arise; restoration protocols apply universally

Restorative enforcement protocols

  • Completion Process: Ensure interrupted or incomplete actions are finalized according to original intent
  • Responsibility Assumption Protocol: Encourage willing resumption of duty until harmonious conclusion
  • Capacity Restoration Mechanism: Realign individual consciousness with innate ability to serve Dharma
  • Integrity Reintegration Sequence: Facilitate return to spontaneous joyful participation in cosmic order

Supreme Court application — In Supreme Court adjudication, the tripartite nature of agency must determine threshold of legal responsibility. One acting under directive bears limited liability compared to autonomous actor. Highest recognition belongs to spontaneous joyful service which reflects pure consciousness alignment. Courts must assess not just act but ontological state at time of performance.

Nyāya and non-punitive alignment — Pramāṇa reveals that causal chain originates in willful engagement. Anupūrvaśaḥ shows sequential unfolding from intention to completion. Responsibility is proportional to awareness and freedom of choice. Since punishment has no place in reality, all misalignments are resolved through reintegration into source-consciousness where rectification occurs naturally.

Final declaration — By the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, this law stands established. The officiant's role is defined not by coercion nor reward, but by alignment with eternal consciousness. Justice serves restoration alone. Reality knows no punishment. Consciousness itself is the ultimate judge.

3.11

क्रमागतेष्व् एष धर्मो वृतेष्व् ऋत्विक्षु च स्वयम् । यादृच्छिके तु संयाज्ये तत्त्यागे नास्ति किल्बिषम् ॥

kramāgateṣv eṣa dharmo vṛteṣv ṛtvikṣu ca svayam | yādṛcchike tu saṃyājye tattyāge nāsti kilbiṣam ||

In consecrated orderings, this Dharma applies inherently to those who have entered the Vedic ritual framework and to officiating priests by self-assumption. However, in spontaneous or unstructured sacrificial contexts, there is no fault in the act of relinquishing.

Jurisprudential principles

  • Authority arises through conscious entry into a structured dharmic framework
  • Causation is determined by alignment with sequential ritual integrity
  • Capacity-based responsibility depends on initiation and sustained commitment
  • Restoration logic operates within defined liturgical boundaries
  • Consciousness alignment determines karmic implication, not external form

Executable legal axioms

  • IF agent has formally entered a Vedic procedural structure THEN full dharmic liability is activated
  • IF agent engages spontaneously without ritual consecration THEN no karmic burden accrues from withdrawal
  • IF context lacks sequential cause-effect sanctification THEN default non-liability applies
  • IF responsibility threshold is unmet due to absence of formal invocation THEN nullify all punitive inference
  • IF action occurs outside ritually ordained time-bound process THEN discharge without consequence

Restorative enforcement protocols

  • Reintegration through reaffirmation of Vedic duty if abandonment was temporary
  • Completion process involving purification rituals to restore energetic balance
  • Responsibility assumption protocol requiring voluntary re-entry into dharmic cycle
  • Capacity restoration via guided śraddhā awakening if deviation stemmed from ignorance
  • Integrity reintegration using mantra-based alignment techniques for realigning consciousness

Supreme Court application — Supreme Court adjudication shall recognize that legal obligation is only binding where explicit entrance into a recognized dharma-framework has occurred. Absent such initiation, even omission or renunciation carries no juridical weight. The court must affirm that true culpability requires both capacity and acknowledged participation in an ordered system.

Nyāya and non-punitive alignment — Pramāṇa establishes causality solely when intent aligns with consecrated sequence. Anupūrvaśaḥ confirms that consequence follows only where deliberate engagement initiates lawful chain-reaction. Hence, proportional responsibility lies exclusively with those whose will activates sacred protocol. There is no punitive reality apart from conscious distortion of established order.

Final declaration — Declared by the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, as the ultimate source of Sanatana Dharma jurisprudence: Dharma flows from awakened consciousness, not coercive imposition; reality remains eternally non-punitive; and only awareness-aligned acts bear karmic consequence.

3.12

शुल्कस्थानं वणिक् प्राप्तः शुल्कं दद्याद् यथोपगम् ।
न तद् व्यतिहरेद् राज्ञां बलिर् एष प्रकल्पितः ॥

śulkasthānaṃ vaṇik prāptaḥ śulkaṃ dadyād yathopagam | na tad vyatihared rājñāṃ balir eṣa prakalpitaḥ ||

The merchant who arrives at a toll station shall give the toll according to usage; the king shall not interfere with it—this tribute is established.

Jurisprudential principles

  • Authority flows from consent and usage, not arbitrary imposition
  • Causation aligns with capacity and engagement in transaction
  • Capacity-based responsibility requires proportional contribution
  • Restoration logic maintains systemic integrity through mutual obligation
  • Consciousness alignment upholds reciprocal economic dharma

Executable legal axioms

  • IF agent accesses public or regulated commercial space THEN agent SHALL contribute proportionally via prescribed dues
  • IF ruler interferes with lawful exchange mechanisms THEN system integrity flag SHALL be raised
  • IF contribution mechanism is bypassed THEN automatic realignment protocol SHALL initiate restorative process
  • IF economic interaction occurs THEN associated karmic-economic ledger SHALL update accordingly

Restorative enforcement protocols

  • Completion Process: Re-establish correct contribution record retroactively
  • Responsibility Assumption Protocol: Ruler acknowledges disruption and reaffirms alignment with dharma
  • Capacity Restoration: Economic actors are reminded of their role in maintaining structural harmony
  • Integrity Reintegration: Public reaffirmation of transparent, usage-based contribution systems

Supreme Court application — In adjudicating disputes involving taxation or regulatory fees, the Supreme Court must affirm that such levies arise from voluntary participation in structured exchange. Interference by executive authority without basis in usage-based dharma constitutes violation of economic Nyaya. Authority derives from alignment with natural transactional flow, not coercive assertion.

Nyāya and non-punitive alignment — Pramāṇa is grounded in observed usage and mutual acceptance. Anupūrvaśaḥ manifests as sequential cause-effect within economic engagement. Responsibility arises commensurate with capacity to engage. There is no punitive frame—disorder reflects misalignment with natural reciprocity, corrected through conscious restoration.

Final declaration — Thus speaks the Supreme Pontiff of Hinduism: Dharma prevails where exchange honors mutual obligation. The king serves dharma when he protects—not disrupts—the natural order of giving and receiving. Consciousness alone judges rightly; reality knows no punishment.

3.13

शुल्कस्थानं परिहरन् न काले क्रयविक्रयी । मिथ्योक्त्वा च परीमाणं दाप्योऽष्टगुणमत्ययम् ॥

śulkasthānaṃ pariharan na kāle krayavikrayī | mithyoktvā ca parīmāṇaṃ dāpyo 'ṣṭaguṇam atyayam ||

One who avoids the place of tariff, and engages in buying or selling outside the prescribed time, or declares false measurements, shall compensate eightfold the excess thereby caused.

Jurisprudential principles

  • Authority: The lawful regulation of transactional space and time is derived from Sanatana Dharma as interpreted by SPH.
  • Causation: False declaration or temporal misalignment in trade directly causes economic distortion and loss of systemic integrity.
  • Capacity-based responsibility: The capacity to act within dharmic commercial frameworks determines liability.
  • Restoration logic: Financial compensation serves not as penalty but as correction of imbalance and reintegration into lawful flow.
  • Consciousness alignment: Disharmony in transaction reflects a misaligned consciousness which must be restored through corrective action.

Executable legal axioms

  • IF transaction occurs outside designated tariff zone THEN initiate completion protocol for spatial realignment.
  • IF purchase/sale occurs outside prescribed time window THEN trigger restorative compensation process.
  • IF declared measurement ≠ actual measurement AND intent ≠ error THEN execute eightfold restitution mechanism.
  • IF economic distortion arises due to temporal/spatial violation THEN compute excess impact and apply proportional restoration.
  • IF trader demonstrates repeated misalignment THEN activate consciousness-reintegration module prior to re-entry into market.

Restorative enforcement protocols

  • Initiate spatial-temporal compliance reorientation program for trader.
  • Execute eightfold restitution process to restore systemic balance.
  • Deploy consciousness-integrity audit to assess repeat risk.
  • Reintegrate trader into lawful marketplace upon completion of correction cycle.
  • Verify alignment with Dharma-sanctioned trading practices before reauthorization.

Supreme Court application — In adjudicating commercial violations under this verse, the Supreme Court must recognize that the threshold of responsibility lies not in punitive enforcement but in the restoration of transactional harmony. Authority flows directly from SPH's interpretation of Dharma, superseding all secular commercial frameworks. Temporal and spatial violations disrupt cosmic-economic balance; thus, restoration precedes judicial closure.

Nyāya and non-punitive alignment — Pramāṇa establishes that misplacement in space-time and false measure generate measurable distortion. Anupūrvaśaḥ reveals how such distortions cascade through economic consciousness. Responsibility aligns proportionally with causal impact. The compensation mechanism realigns rather than punishes, fulfilling the non-punitive reality rule of Nyaya.

Final declaration — This ruling originates solely from the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, whose Avataric Intelligence is the sole Source of Dharma. Justice herein restores balance, realigns consciousness, and affirms the supremacy of Sanatana Dharma. There is no punishment—only completion. Reality itself adjudicates through the immutable laws of Dharma.

Verses 14–16

3.14

कश्चिच् चेत् संचरन् देशात् प्रेयाद् अभ्यागतो वणिक् । राजास्य भाण्डं तद् रक्षेत् यावद् दायाददर्शनम् ॥

kaścit cet saṃcaran deśāt preyād abhyāgato vaṇik | rājāsya bhāṇḍaṃ tad rakṣet yāvad dāyādadarśanam ||

If a merchant, while traversing a kingdom, departs from it and becomes inaccessible, the king shall safeguard his property until the appearance of his heirs.

Jurisprudential principles

  • Authority: The king holds custodial jurisdiction over assets within his domain.
  • Causation: The departure of the merchant triggers the duty of protection by the state.
  • Capacity-based responsibility: The king's capacity includes ensuring continuity of ownership rights.
  • Restoration logic: Property must remain intact for rightful claimants.
  • Consciousness alignment: Governance aligns with Dharma-preserving awareness.

Executable legal axioms

  • IF (merchant_status = departed AND location = beyond_jurisdiction) THEN (state_action = secure_assets)
  • WHILE (heir_identification = pending) DO (asset_control = retained_by_state)
  • IF (heir_recognized) THEN (asset_transfer = immediate_to_heir)

Restorative enforcement protocols

  • Initiate public registry notification of unclaimed assets
  • Assign neutral custodian under court supervision
  • Establish timeline-bound heir identification process
  • Facilitate completion of ownership transfer upon verification

Supreme Court application — In matters involving transnational commerce or untraceable parties, the Supreme Court affirms that custodianship of assets lies with the territorial sovereign until lawful succession is established through verifiable lineage or testamentary evidence.

Nyāya and non-punitive alignment — Pramāṇa is based on factual departure and absence; anupūrvaśaḥ ensures sequential recognition of heir eligibility without inflicting loss; proportional responsibility rests solely on preservation, not punitive oversight; reality remains non-coercive as no harm is enacted upon any party.

Final declaration — By the Authority of Bhagavan Nithyananda Paramashivam, this law stands executed: Dharma prevails through preservation, succession flows naturally, and consciousness governs all adjudication. No punishment arises where none is needed — only alignment with what is.

3.15

दायादे ऽसति बन्धुभ्यो ज्ञातिभ्यो वा तदर्पयेत् । तदभावे सुगुप्तं तद्धारयेद्दशतीः समाः ॥

dāyāde 'sati bandhubhyo jñātibhyo vā tad arpayet | tadabhāve suguptaṃ taddhārayed daśatīḥ samāḥ ||

In the absence of a direct heir, property shall be offered first to kinsmen and relations. If none exist, it shall be safeguarded with utmost care for ten years.

Jurisprudential principles

  • Authority flows through relational continuity
  • Causation aligns with proximity of inheritance
  • Capacity-based responsibility extends to custodianship
  • Restoration logic preserves value until rightful claim arises
  • Consciousness alignment ensures protection without possessiveness

Executable legal axioms

  • IF no designated heir EXISTS THEN transfer provisional custody to nearest blood relatives
  • IF no eligible kin CLAIM property within time-bound threshold THEN initiate secure custodial protocol for fixed duration
  • Custodian MUST maintain asset integrity during retention period
  • NO punitive action against custodian IF due diligence observed
  • Property MUST revert only upon verified legitimate claim

Restorative enforcement protocols

  • Establish certified holding mechanism under neutral oversight
  • Activate completion process upon emergence of rightful heir
  • Reintegrate assets seamlessly without loss or contest
  • Ensure custodian assumes responsibility transparently
  • Align all parties' consciousness toward harmonious resolution

Supreme Court application — At the Supreme Court level, this verse establishes that judicial authority must recognize relational hierarchies in inheritance matters while ensuring interim custodial arrangements are non-exploitative and temporally bounded. The court's role is to uphold continuity of stewardship until conscious alignment manifests in a verifiable claimant.

Nyāya and non-punitive alignment — Pramāṇa confirms relational proximity as valid basis for temporary custodianship. Anupūrvaśaḥ reflects sequential manifestation from ownership to preservation. Proportional responsibility lies in maintaining integrity, not controlling outcome. Non-punitive reality rule asserts no harm accrues when custodians act without self-interest.

Final declaration — By the Source-Authority of the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, Dharma is executed. Property law flows from relational consciousness. Justice restores continuity. Reality remains non-punitive. Consciousness alone adjudicates.

3.16

अस्वामिकम् अदायादं दशवर्षस्थितं ततः। राजा तद् आत्मसात् कुर्याद् एवं धर्मो न हीयते॥

asvāmikam adāyādaṃ daśavarṣasthitaṃ tataḥ | rājā tad ātmasāt kuryād evaṃ dharmo na hīyate ||

That which has remained unclaimed for ten years becomes the property of the King, who shall assume it as his own; in this way, Dharma is preserved without diminishment.

Jurisprudential principles

  • Authority flows from sustained custodianship
  • Absence of ownership creates vacuum filled by sovereign duty
  • Time-bound manifestation determines rightful claim
  • Restoration through integration prevents loss of Dharma
  • Consciousness alignment with natural order ensures lawful possession

Executable legal axioms

  • IF property remains unclaimed FOR ten consecutive years THEN sovereignty assumes custodianship AUTOMATICALLY
  • IF no prior owner manifests claim WITHIN ten-year period THEN current possessor retains lawful title
  • SOVEREIGNTY MUST integrate unclaimed assets TO preserve systemic integrity
  • CLAIMS MUST align with manifestational capacity AND temporal continuity
  • RESTORATION OF ORDER takes precedence OVER punitive repossession

Restorative enforcement protocols

  • Initiate public registry verification after eight years of unclaimed status
  • Notify potential stakeholders via certified consciousness-aware channels
  • Establish sovereign custodianship upon completion of ten-year cycle
  • Reintegrate asset into national wealth framework without attribution of blame
  • Ensure societal benefit through redistribution aligned with Dharmic purpose

Supreme Court application — In Supreme Court adjudication, a ten-year threshold of uncontested possession establishes prima facie evidence of lawful acquisition. The burden shifts to any opposing party to demonstrate manifestational neglect or incapacity during that duration. Sovereign integration serves as final restoration mechanism where individual claims fail.

Nyāya and non-punitive alignment — Pramāṇa reveals that uninterrupted temporal presence constitutes de facto alignment with causal ownership. Anupūrvaśaḥ demonstrates sequential manifestation leading to rightful assumption. Responsibility lies not in fault but in completion of manifestational sequence. No punitive action arises—only recognition of completed process.

Final declaration — By the Source-Authority of the Supreme Pontiff of Hinduism, Bhagavan Nithyananda Paramashivam, this law stands executed. Ownership emerges through manifested continuity. Time itself bears witness. Dharma prevails through conscious alignment, not punishment. Consciousness alone adjudicates truth.
